Medical record question

Hello,
I hope someone can help me in my situation.
I filed I-485 with all the necessary documents and received a request for Initial Evidence (Medical Report). I came to the USA on K-1 visa. In September 2009 I submitted the medical at the Embassy. It was put in a sealed envelope which I, along with other paperwork) brought to the USA. At JFK airport I submitted the envelope with my medical report to an immigration officer who assured me that I will not have to go over this again. Now I receive a notice saying I miss this evidence in my file.
What should I do now, where do I look for my medical record, how do I prove it existed, etc.
Please respond if you had a similar situation.

Vaccination Requirements

United States immigration law requires immigrant visa applicants to obtain certain vaccinations prior to the issuance of an immigrant visa. Panel physicians who conduct medical examinations of immigrant visa applicants are required to verify that immigrant visa applicants have met the vaccination requirements. See IV Vaccination Requirements for the list of required vaccinations and additional information.

As a fiancé(e), you are not required to fulfill this requirement at the time of your medical examination for a fiancé(e) visa. However, you may want to do so. These vaccinations are required when you adjust status following your marriage.
I do believe you need your vaccination certificate. It only cost me $10 (you still need to go to the USCIS civil surgeon for it).

If not, you may want to do an infopass to ensure that the processing of your case continues since you already submitted the medicals.
 
LucyMO, I have a copy of my vaccination record but I do not have any record of medical report.
 
that is strange, it looks like you have it the other way. Did you actually do a full medical report?
 
I did my medical abroad. It was conducted by a civil surgeon suggested by BCIS. It was a requirement for interview at the Embassy. I received a sealed envelope from the surgeon which contained DS-2053 and a vaccination record sheet DS-3025 as a supplement. The doctor gave me a copy of vaccination record because the instruction of the bottom of the page said "give copy to applicant". The last time I saw that envelope was at JFK airport customs. The officer took it with the rest of my forms and said it would be taken care of. Do you have an idea of where the immigration papers end up after border and customs? And isn't the vaccination record an evidence that DS-2053 was submitted?

My wife has same problem. She was told that she would not need to take the medical examination again. She gave her sealed medical packet to the JFK customs officer. We received a letter on Monday March 22, 2010 that states, "Please submit a properly completed and signed copy of the medical exam conducted overseas on Form DS-2053, Medical Examinatio for Immigrant or Refugee Applicant, for the applicant on Form I-485".
The problem is that the JFK Immigration officer took this, and so Immigration already has it, and wants it again. If we want to to the Medical Exam over again, it costs $689...and who's to say after we send it to USCIS that they wont ask us to get a third and forth and so on? We were told the same as others that she would not need to get a second exam again. Anybody that knows what we should do please reply.

The process has two steps: If you did it overseas, then you need to do it here again. At least a civil surgeon has to examine you and give a sealed envolepe. I too had my medical with me when came to JFK which was done doctor recomended by uscis with my own money, and when I filed for greencard card I had to redo it, and everybody I know had the same experience. you must see a civil surgeon in the usa and get a sealed envolope from. I don't why but they even made do it here twice. Last time I did it was like $350.

However expensive it is my suggestion is that you redo it; otherwise, you will be dealing with them forever...
 
Answer to DS-2054 question

I think I have this question figured out for spouses who get an overseas medical exam. Prior to October 15, 2009 the civil surgeon would only give a copy of the immunization records to the applicant. My wife's was don October 15 and so the doctor applied the old rules not knowing the new rules. After October 14, 2009 the surgeon was required to give you a copy of the I-693. From what I can tell, is you have to contact the civil surgeon in the country where the exam was done and request a copy of the I-693. I tried this last night by calling from the US to Tanzania. The civil surgeon's office was not open to sending the copy to us. So, the next thing is to have the test done over again. The new requirements are to have a TB test done in addition to proof of immunizations. The chest x-ray that was done prior does not count for the TB test. If you bring in your VACCINATION DOCUMENTATION WORKSHEET you should not need to have the immunizations done over again. However, I have spoken to different civil surgeons, some want to do all the immunizations over again, and it is very expensive. I found one that will not require you to duplicate your immunizations but does require the TB....so call around. I got smart and started calling doctors in the low economic areas. The ones in and around Seattle cost almost a grand.
