Chest XRay Abnormal -- Will my case be transferred?

--------------------------------------------------------------------------------

i just read this pdf explaining the procedure for ruling i485's and found that it says regarding medical exam.
1. if the chest x-ray is abnormal ,relocate the file to district office.
my chest x-ray is abnormal and doctor has said i have inactive TB germs . i am already unergoing treatment. He also said that i do not have any abnormality and has also checked 'No abnormality / disease etc ' on my medical and given me clearance.

1. Does this mean that my case will be transferred
2. if yes is this a good/bad thing ?.
3. also i live in mid west and my company is in CA .my case is at CSC .where will my case be transferred if it does ?
4. Has anyone been in this situation before.
thx for ur responses in advance.
5. Should i do something right now or just wait and watch.
6. can my 485 be denied too. pls note that i have been given medical clearance and my doc said that i have inactive TB germs and he said it is common in asian people.

I485 RD June 28th 2004.

1. Does this mean that my case will be transferred
Unfortunately, the answer is probably more yes than no.
2. if yes is this a good/bad thing ?.
It's bad only because you'll have to go to an interview and they don't specify what you need to bring until you get there. They give you just a generic list of documents related to family cases.
3. also i live in mid west and my company is in CA .my case is at CSC .where will my case be transferred if it does ?
To your local office, don't worry.
4. Has anyone been in this situation before.
Yes. Search this forum.
5. Should i do something right now or just wait and watch.
As soon as you're done with your treatment, go to the doctor and ask him/her to give you the updated medical results, again sealed as 1st time.
6. can my 485 be denied too. pls note that i have been given medical clearance and my doc said that i have inactive TB germs and he said it is common in asian people.
Nope, you won't be denied.

re:

ruxrux . thanks for ur response.

1. can u pls clarify where the case in all likelihood will be transferred in my case CA or Mid west ?. if my case is transferred to mid west .. is it like getting transferred when someone moves. i have heard that people then cant track their case ??. is that true..
2. the treatment that i am taking is because of my will, i mean doctor gave me an option and said ur medical is done with .. now if u want u can take thos treatment. do i still need to send the updated medical exam after treatment is complete.
3. u said there are people who have been thru this .. do u mean who have been thru medical complication or who have been transferred. i am unable to find someone who was transferred because of TB/medical issue .. can u post a link if u have handy.

re:

ruxrux.
i see something mentioning td vaccine in ur profile. can u pls share ur experience. seems like u might have hade medical issue too

1. Your case will be transferred to the CIS office local to where you live, not where your company is. Example from a user of this board - he lives in Sunnyvale and works in Daly City. His case was transferred to SJ office, not SF.
2. About the treatment - doctors always prescribe it, even if it's obvious that you don't need it, just to comply with what CIS asks. The only important thing is: what did your doctor write in the medical form, under "TB" - normal or not normal. As long as the "normal" box is checked, it does not matter what's in the big box below it (medical explanation of your condition) and you'll be approved without transfer.
The problematic case here was the guy who had this situation: smoker, no TB in lungs, TB test positive (vaccine in childhood). Doctor checked "not normal" and gave the explanation that there's no TB, just the smoking thing on X-rays. Case transferred to local office. Officer refused to look at doctor's explanation, sent the guy back to doctor to write another medical form. Doctor did it, with a lot of complaints because he could not say "normal" while the guy had smoker lungs. Officer approved the case.

3. I meant through the TB/medical things (see 2 above).

My case was this - I was transferred because of a totally different thing - I has a lot of army history in my country (war/draft...) and I forgot to mention army reserve, but background check said I was in reserve so they wanted an explanation. The CIS officer asked me about it and I answered, that part was done in a minute. Then she saw that my wife got no TD vaccine - there was a shortage in Nov 2001 when we did the medicals and doctor put "Not available in US" so we got RFE at the interview for the TD vaccine. I had also not been vaccinated, but officer didn't notice that.

re:

Thanks ruxrux.
Under Examination for TB it is marked ABNORMAL. Also in remarks section it is mentioned -- No suggestion of TB, no emdance of active TB , CT scan performed.
So this means that my case will definitely be transferred and that too to Des Moinse office in Iowa.
Thanks again.

Don't despair, maybe you get lucky and get a RFE! I don't know how efficient Des Moines field office is, but you can at least get ready beforehand with the new letter from doctor.

re:

thanks ruxrux. is there a way to find out how much time des moines office usually takes. i know a friend for whm they took 2 years after his case was transferred but i am hoping that it was just one such case like that .... anyways i am not worrying b'cos i dont know what lies ahead. pls let me know if u know abt timings for des moines.
