MD's WITH J1 WAIVER & NIW WITH PENDING I 485

Hi all, I'am a J1 MD finishing the 3 yrs commitment in sept 02. My NIW was approved in sep 01. I filed my I485 in march 02, got fingerprinted ( surprising ) in april 02. Anybody else in similar or more fortunate position ! I never filed for LC.

I am also an MD, with self-petitioned NIW approved in 12/98, filed in 08/98. I will finish my 3-yrs in MUA on H-1B in 12/02. I have not applied for I-485 yet. Is it safe to apply before 3-yr requirement is up? Please share your experience...was your NIW self-petitioned? Until how long are you obliged to continue in MUA? With which service center did you file I-485? Can you move to another non-MUA job once your 3 yrs is up...? Your advice will be much appreciated...Thanks in advance..
 
Service center is CSC,one can apply for I485 before finishing three years in J1 waiver provided they have an approved NIW but the final GC approval will be done only after finishing an aggregate of five years in MUA/ HPSA. One can change to another MUA/HPSA area after three years but an amended I140 application may be needed, though if I485 is filed for more than 180 days one may not need that. This issue needs further clarification from INS (portability laws still not clear).You may want to speak to your attorney regarding this matter.

Thank you for your reply. Since my NIW was filed before Nov 98, isn't my MUA/HPSA requirement only 3 yrs? Once again I would appreciate your response...wish you luck, would like to correspond with you via e-mail if possible...

I am also a former J holder finishing my waiver in oct 2002 got NIW approved in May 2002 applied for 485 2 weeks back lets see if I also get FP notice or not.
well if one's J was approved before Oct 1999 then one has to fulfill only 3 yeras
yes one can file for 485 while doing 3 years of waiver

Anyone with experience of job change while still fulfilling the 5 year commitment, please post your comments. The question is whether an amended I140 is to be filed if the I485 has been with INS for more than 180 days.

which service center did u file ur 485 it would be really nice to know if we guys can change the job with 485 pending for more than 180 days
