May I go to Canada for Asylum as I am never called in court for my case

Hi

I have applied for political asylum and I only received my work permit and my social security number. I never have an immigration appointment to defend my case.

Do you think I can be welcomed in Canada for asylum as I never have a chance to go court in the US?

When did you apply?
Have you had your interview yet? What do you mean you never had a chance to defend your case?

Think he meant he has never been called for interview. My dear stay where you are, they will answer you in due time, you have your permit be patient
 
No you cannot. You cannot even touch US soil and then apply for asylum in Canada, much less apply for asylum here first, then apply for asylum in Canada. There is an agreement between both the US and Canada where you MUST apply for asylum in whichever country you touch first. Do not leave the country. Just stay put where you are and wait, wait, wait. There's nothing else to do. Best of luck.

Why you want to apply Asylum in both countries?
 
do not do this , just wait . you already have a work permit so just continue with your life , you are in a better situation than many asylum seekers .

based on the 3rd country agreement between US and Canada , you can not apply for asylum at a land port of entry if you do not have a Canadian visa . there are exceptions like having family members in Canada . but recently thousands have applied for asylum by using the illegal entry outside the official POE loophole , remember that crossing is a crime unless you apply for asylum . also remember that if you are out of status in the US you might get detained by US border patrols before you are able to reach Canada . also if you think you have no chance getting asylum here what makes think you will get approved in Canada ?

I applied in January 2018 and I received my DEA in August that same year.

I still don't have an interview. That's why I don't know what I can do. I did not apply to have the DEA but for the safety of my family. Now the political situation is getting worse and I would like to have my family with me. That's why I am wondering if I would be welcome in Canada as it is taking too long here in the US.

You can. However you'll be in for another long wait. Canada has a backlog right now and you're probably looking at 3 years before you have a hearing. Assuming your claim is accepted, you're then looking at another 2+ years for your permanent residency application to be processed. Your family won't be able to join you in Canada until all of these steps are complete. So assume around 5 years (maybe more) from the time you arrive in Canada until your family can join you.

Assuming you have no family members in Canada, this means you cannot enter Canada through a land border due to the safe third country agreement. In that case your only option would be to cross into Canada illegally if you want to make a claim. But again, be aware that it will be years before your family will be able to join you.
 
I think that this is a legitimate issue that everyone who has had to wait 2+ years to get their asylum approved have thought about. At least some of your have an EAD and can work. Some of us got stuck in the backlogs 2+years, with no permission to work. Can I go somewhere else to apply? When will I be with my family? Will this process ever end? Can moving to Canada help? Can I give up the wait, go back to my country where death squads from the government are waiting? Can I take my chances there? Can I go to France and join the Foreign Legion? Can I go to Europe, Germany? These are questions people ask themselves as they sit around all day, waiting to hear from USCIS, as they watch their lives wasting away.

You always have that option...Just make sure it really have any benefit doing that
 
Last time I met a lawyer in Canada she told me starting from April 2019 Canada no longer accepting "shopping asylum" asylum cases for people coming from the USA to Canada legally or illegally after they already applied for asylum in the USA, only very few cases under very special circumstances this new law doesn't apply to it.

You Right kallowdean :) , the lawyer could be wrong or didn't give me a correct or clear answer. But you can do some research by yourself on the internet, just google " Canada asylum shopping"
Or watch this news interview to get some ideas about the whole situation.

What I would like to know is whether or not I can cancel my asylum case here in the US as it is taking so long and then go to Canada and apply for it.
I know about the convention about Canada and USA but staying here is not helping my wife and my kids that are in danger in Haiti now.
I really would like to know if I have a chance to be accepted if I cancel my case here.

Canada has its own backlog. It almost takes 3 years now there and it keeps getting lenghtier

Submitting an application in Canada won't help your wife and kids for many years.

As said previously, Canada's processing times for applications are very long now. You'll be waiting 2-3 years for the refugee claim to be processing and then another 2 years for the PR application to be processed if your refugee claim is accepted. Your wife and children will NOT be able to come to Canada while these applications are being processed. This means that from the time you come to Canada and apply, you are looking at 4-5 years before your family will be able to join you - so sometime in 2024 or 2025 is when you should expect your family to be able to come to Canada.

FYI - refugee claim acceptance rates in Canada for those from Haiti are low. Only around 10%.

Okay thank you.
In that case , is there any how i can write USCIS about my case? Or do you think I may need a lawyer in order to help me to have my case go faster?
