Marrying GC holder

Hello to all,

I am from India. My Fiance is in the US as GC holder. He is a divorcee. He went in H1B and processed the GC for his famlily, but now they are seperated, only his son with him.

1. Is there any problem for me to join him after we get married? (2) how to come to US after we both got married? is there any visa type for GC holders to sponsor their spouces? (3) how long will it take for the processing? what is that type visa?

1. could the GC holder file I-130 for his spouse under family base GC when i am here in India itself after our marrige?

2. could I travel to the US in visitor visa stating that my husband is in US? (Will they ever issue visa then?).

Thank you very much for your reply. Could you also tell me, how long will it take to apply for the citizenship? After the marriage, if he applies for my GC, it will take 5 years know..as you said..? then if we get child by that time, then child will also be eligible to travel US with me?

I don’t understand why it is so like this, that it takes 5 years to join the spouse... where as other visa holders could take their spouses without any problem. If the INS wants us to proof the honesty of our marriage for 5 years, then it could allow us to join know? Will this law change in future at least? It wants the Green card holders alone should be separated from their spouses or what?
