Marrying after getting GC

Hi,

Me and my wife got GC 2 years ago through my employer. We got divorced a couple of months ago as she has different plans about her life.

If i marry a girl from outside US, I know that it would take 3-4 years for her to come to US as I am a PR.

Is it possible for me to go back to H1-B status by cancelling my GC. Get married and bring my wife on H4 and reapply for GC through my employer?

I know of a guy who gave up his GC 10 years ago and moved to India. Later, when he tried to visit the US (his siblings are here), the US Consulate refused, considering him like any other applicant. The fact that he was in the States previously has no bearing simply because of his decision to give up GC.

It seems that those who give up GC may not probably get a non-immigrant visa.

I would defenitely advise against it. You mentioned that you got your GC about 2 years ago. So it would take about 3-4 years to get your citizenship. I am not sure about the situation at your local INS office, but I suspect it would take about 3 years or so to get your GC once you apply for it from H1. Best thing to do would be to bring your wife here on F-1 visa, and then get married here, have her maintain her status till you become a citizen. Plus with the current economic situation and changes in the new laws, political climate etc. , why would want to take that kind of risk!!! I personally know of a friend, whose employer has decided not to sponsor for GC. The mgmt changed at his firm and the new top brass does not want to hire/have anything to do with H1 etc..
Of Course they dont fire bec they dont have a cause, but they just turn deaf when he mentions about the Labor Process/GC.
