first of all thanks for taking your time to read. this is my situation my girlfriend is a US citizen i am a mexican citizen i came to US with a tourist visa when i was 16 i overstayed because my parent wanted to my girlfriend is 18 and i am 20 i would like to know if anyone knows what i can do to get permanent residence or if it would be better get married in the US or mexico. by the way my visa expired and my form that shows i entered US got lost please i really need help
 
exactly i have no proof i think my parents did soemthing to it i wish i still had it i have been lets say illegally for 5 months my visa expired on december 25 thanks for the replies i really appreciate them
 
The expiry date on a visa is irrelevant. Its the date written/stamped on the I-94 that determines your status.....someone could have a tourist visa valid for 10 years...this does not mean they can stay in the US for 10, they can only stay in the US for as long as the date written/stamped on their I-94 (usually 6 months) before they need to leave or become out of status. As you state that you entered on a tourist visa then you were probably only given a 6 month stay. This means that you have been out of status/illegally present 6 months after you entered the US.

well now that i think about my parents did turned in the I-49 because my mom has been in Mexico twice i think and my brother who lives over there right now has come over 3 times and we all came at the same time so it does mean that US thinks we are in Mexico not in US which makes me really happy because i would not get banned i was really scared i love my girlfriend a lot and i would anything for her but i dont want to leave her thats why I am asking this. I really dont want to go to Mexico but if its something i have to do well i will do it. I got another question what would be faster or easier? I coming to US with I-49 and get married during the 6 months? or she going to Mexico and get married there? or Wait for a K-1 visa? i am asking this because i really dont want to stay in Mexico for a long time. please just help me with this last question i am really worried.

Since you know that date of your visa's expiry, them Im assuming that you have your passport still.

Do you not have a stamp in your passport indicating your entry and the date indicating the length of stay that was granted?
 
I have a feeling that you are withholding some information.
Anyway if you entered the country legally, you won't have much problem.
INS database keeps all records of entry/departure. (Laser cards included no worries there)
Your best bet is to marry your girlfriend ASAP and have someone sponsor your stay.
I suggest you don't leave the country if you have prior conviction (overstay, etc) since it'll
be harder for you to obtain another visa.
 
what if someone turned my I-49 in? can i get banned? remember i have been here for 4 years i am 20 right now i just dont want anything to happened i want to do it as legal as possible
 
If someone turned in your I-94, then you should not be in the country, correct? So how will you defend that during your AOS interview?

So... basically you are in the country illegally now.
Tricking the US goverment in a sense, yes?
Mind you, I'm not here to judge... so best telling the truth.
