Marrying a US Citizen living on a different state

Hi Folks,

Need help from the gurus. I am working in Chicago and my status is currently H1B. I am planning to marry my high school sweetheart this Christmas (December, 2002) in Las Vegas. She's a US Citizen and presently residing in Los Angeles, CA. My concerns are:

1. What's the current address I'm going to fill-in the application forms?

2. If it will be in California, will that creates a problem since my present employer is in Chicago? Our plan is for me to relocate in Los Angeles after I get my work permit. Moving in California without a job waiting for me doesn't seem to be an option.

Any inputs will be greatly appreciated. Thanks

I have another question if you dont mind. Will the INS ask for an employment certificate? If they will and found out that my current address is in Chicago and not in California, will this going to be a ground for denying my petition?

If you are eventually going to be in Califorina thats where you file. Or you can file in chicago & request your file be transferred when you move to California
 
Yes, at time of AOS They Need Employer Letter

Depending on back log, it may take 4 to 6 months until you are called for AOS Interview. You will be called for EAD ijn 90 days. The prudent thing is, if you are not sure, you want to be in CA in 4 to 6 months, you can file at Chicago, get your EAD in 90 days (BTW,, for EAD they do not ask where your spouse lives, but you have to provide Chicago address, than immediatley after getting EAD transfer to CA, as you mentioned above that you definitely want to move aftre EAD).

Beware, that there is a 5% chance of file being misplaced. Keep Good Copies and take all copies to EAD as well, in case.

Did you guys discuss that she can move to Chicago for six months so you can adjust your status and than move to California. She can visit Chicago and havew ILLINOIS DL or ID made. That is the only thing needed if she is not working.
