If you attempt the I-601, what is the basis of your "extreme hardship"? Are you disabled and depending on your spouse for day-to-day care? Make sure you have a realistic chance before you waste thousands of dollars on lawyers for a hopeless case.

Regardless of personal views on illegal immigration, compassion and understanding are always warranted. And yes, the 10 year ban for a spouse of a US citizen and father of a 2 1/2 year old is difficult to understand even for me and I have a PhD in engineering, and no, it is not clear, there are some legal paths that can be taken, and although they may be rough and difficult to traverse they offer a glimmer of hope for this family. My advice to Rezobeman is to research the I-601 route and get a good immigration lawyer. Your research will help you distinguish the good lawyer from the quack and be prepared to spend some money. Good things in life require effort.

It is very simple. If he stays in the US, he cannot legalise his status. If he leaves the US, he cannot return for 10 years. It is not that difficult to understand. Are you clear now?
 
Go to avvo.com and look up lawyers in MA. Btw, NYC has some of the finest lawyers in the country too - just because there are many immigrants in the state. Also, I personally would look up lawyers who were past/present presidents of local AILA chapters. You should also see if they are certified immigration attorneys. That will be a good start...

We all understand human suffering and hardship. But given the facts presented by the OP there is no law that can help her husband legalize his status in the US. :(
