Hi Everyone. I'm just trying to help out my wife friend. The Girls is American Citizen. Her husband crossed the border 15 years ago. Got caught and deported back to mexico and sometime after he got deported he crossed the border again. He got married to my wifes friend a while back and they now have two kids. They consulted a lawyer and lawyer said he has to go back to mexico. My wifes friend would like to know if there is any other way around that. Can he just file for a petition and adjustment of status. From what I understand, since he wasnt inspected he has to go back to mexico and also pay a fine. Please advise.. Thanks in advance
 
He does not qualify to adjust status in the US. He would need to get a waiver to even re-enter. Not sure what USCIS would say about the illegal re-entry.
 
Unfortunately the illegal entry pretty much closes the doors on him to adjust status on US soil. Get a really good lawyer to see what he can do if he tries to adjust from mexico .good luck
