Dear all..I have been reading the posts here for a long time but havnt been able to find what I hav been looking for here. My question is I was in US on my J1 visa and got married while I was there. Had to return back and currently in India. Spouse will be USC in the first week of MArch and my I130 has been recently approved. How to expedite my case to get my GC or travel to US or do I hav to file for I 485? PLease help.
Thank you.

when were you married? When you say the I130 is approved, does that mean that you have got the visa number ?

Hi Sreeleshk..thanks for the reply..well I got married in 2006 but had to return back to India in 2007. Had filed for I-130 before leaving the States. My I-130 got approved a week back. MY spouse is to be a USC early March this year. I hav not got my visa number. I dono what is the next step. Do i have to file for I-485 but I am not in the US..and waiting for the priority date is still a long way to go. Is there anyway to expedite my case after my spouse becomes UCS?
Thanks alot.

Once your spouse becomes a US citizen a copy of the naturalization certification should be sent to NVC, requesting that the case be upgraded to that of an Immediate Relative.

CR1 route IR, CP route. we r still looking at 5-8 months. That would be the USCIS preferred way and the best way, even thought it takes a lil more time, but saves alot of paperwork. with CR1 u enter as an LPR and get ur GC.

good luck

Thank you guys for the prompt reply. It was helpful however since I am in a state where 'waiting and patience' has been a little too much for me..I was wondering if upgrading my case once my spouse becomes a USC..if so how long is it going to take for me to get the visa number and what paperwork do they require?
Thanks alot.

HI...Thanks for replyin back..I appreciate it. So as you said( I am aware that I am asking these questions to a person who knows about these stuffs and NOT a lawyer ;) ) my spouse should upgrade my case as IR by sending in the Naturalisation certificate to NVC..by doing that what would be an approximate timeframe before I can get my visa number and what are the documents required for it?
Thanks.

TheRealCanadian, Jackolantern and Bobsmyth are the wizards in the forum, they know all about it may be even better than a fresh off the boat lawyer, all these guys' suggestions are practical. I have gathered what i know about the visa cases, scenarios like mine from these guys and online searches. but if i am not mistaken we are still looking at 5-8 months. So just for a time frame in mind. shoot for 6 months, after the long wait of a couple of years, its just a few more 'months'. If its okay with you, can you share ur husband's time line in the process? is he having the interview by the first week of March or is he swearing in.

HI.....thanks all for the reply...May I ask if anyone knows what are the documents I need to prepare for the procedure? I would really appreciate if anyone could tell me what r the required documents for the procedure as I am NOT in the US at the moment. If i am not in India and in another country for the last 7-8 months...from which country do i need to get the Police Clearance certificate?
Thank you.
