I have two question:

I am a US resident. I am looking to get married next summer in my country. What kind of Visa my future wife will need, where she can apply and how long it takes.

In May, 2006 I will apply for a US citizen after five year being in this country .Can I put my wife in the document of naturalization. How long the process of the naturalization will take .

If you are a US resident, your spouse will have to wait for the visa number to be available in order to get the residency. At the current rate, its taking anywhere between 3 and 5 years for that. Add name check to it and you are looking at over 5 years. The best thing for you would be to wait to file for your citizenship and then apply for your wife. Also note that you can apply for citizenship 90 days before your 5 years are up.

Thanks again for the respond.
I am going for a month vacation to marry her, will I be able to bring her from my country. What kind of visa she will need. I will wait to file for her green card when I will be a citizen.

No, you won't be able to file for any kind of visa from your side to bring her here. She can try to get H1-B visa.Otherwise she will have to stay there until her visa number become available.

like the previous posts said, unfortunately, you won't be able to file any kind of visa for her while you are still in LPR status (Legal Permanent Resident) that will expedite things. the fiancee' visa or AOS (I-485) are to be filed by USC only. if you just recently acquired your LPR status, i would suggest to file the I-130, which can take a while because she will have to wait for a visa number to be available. but at the same time, you are inching towards eligibility for US citizenship. however, you said you will be eligible for file for US citizenship by May 2006. so filing I-130 for her will actually not expedite things any further. like what amishah said, she can try and obtain a visa on her own, like an H-1, F-1, or something. also, when you go back to your country and marry her, since your are still an LPR, you won't be able to bring her here when you come back. now, if you were a USC, that's a different story. 'ope that answers your questions.

As far as I know also LPRs can file I-130 for their spouses and spouses of LPRs can file I-485. Please check the USCIS websites and/or consult a lawyer.

Nop that is not right. Only spouse of USC who will have visa number available to them can only file I 485.

Spouses of LPRs can only file 485 if they are already in the country on their own independent visa and a visa number for 485 is available from the dept of state. Also the whole process of applying for spouse's LPR is very simple and does not need a lawyer unless there is some complication (criminal background, previous deportation orders and such).
Read the how to from the uscis website at uscis.gov, thats a good starting point.

485

What do you mean by "Spouses of LPRs can only file 485 if they are already in the country" ?

I am in this country on H1. and my husband on GC. So can he file 485 for me? (FYI: he already filed I-130 but not approved yet)

okay let me rephrase that - spouses of lprs can only file 485 if the 130 is approved and a visa number is available from the dept of state.

Questions on applying PR for USC.

Hi there,

For a US citizen's wife and she is a Canadian citizen currently in the US. What form to file for getting her a Permanant resident. I know first I-130 is needed, is there any other form that can be filed with it such as I-485 and EAD application? I think for canadian citizen the visa number is not needed. Please share the filing forms and procedures if you have experienced similar situation or have knowledge on this. Thanks in Advance.
