Marriage with Ex-Parte Divorced

Hi,
I am a US resident, going to india to marry a divorced girl
(she got Ex-parte divorce in india as her USA citizen Husband did not appeared in indian court).

Just have quick question :
Will it be legal to marry Ex-parte divorced Girl ??
Will this Ex-parte divorce will be valid when I will file I-130 to get her to USA ??

As long as the divorce is full and final, yes you may marry her and file an I-130 for her.

Since she didn't have any success with a US citizen, she might be in luck with a US resident now...lol!!! No legal issues with you marrying her, you are free to file for a I-130 form.
