USC marries Out of Status Alien. Will be living apart until alien spouse gets EAD then both can pay for apartment (both are university students, and the distance between cities is quite substantial). On 130 and 485 petition, USC and spouse will put current addresses on forms, showing that they will be living apart. How do you think this will play out in terms of receiving EAD? Will there be any questions or problems? After spouse receives EAD, couple will get a joint lease.

EAD will be approved. But the interview will be tougher and you better be living together and have plenty of evidence of such, or they will nail you.

How will the interview be tougher? Couple has been dating for about 4 years, a lot of pictures, affidavits, etc. Do you think that not being able to work until the EAD, which makes it hard to get a lease on an apartment is a good excuse?

There has to be a marriage before applying for 130 and 485, and the EAD. Can you or others give some sort of timeline as to how to proceed with filing paperwork or any other suggestions. How long does it take to get the EAD after filing paperwork and also, how long before the interview?

You can get your EAD within 90 days of filing I-765. Interview could take anywhere from 6-9 months from the time of filing the GC paperwork/application.
 
All of the timelines you can either find here or on uscis website. What PraetorianXI meant is that you better have legit documentation showing that you are living together (joint leases, purchase papers) which will also incluse utility bills, taxes, etc. Just because the couple was dating for 4 years and has lots of pictures doesnt mean anything, what matters is what you have to prove that the marriage is bonafide, otherwise the interviewer will have lots of questions for you....

1.) Since USC spouse is a student and immigrant spouse does not currently have an EAD, in your personal opinion, do you think this is a good excuse for not living together before the EAD arrives? Once EAD arrives, and immigrant spouse finds a job near the school, they are planning on moving in. How does this sound - this is the only plan that could possibly work for both. On a sidenote, immigrant spouse has a co-petitioner since obviously USC spouse is a full time student; will this become a problem either for the immigrant spouse and/or the co-petitioner?

2.) All the couple wants is to get immigrant spouse's EAD and everything together. The main question is then: Will the papers be denied (I-130, I-485, and I-765) just because there are different addresses for the couple or will we get an interview (to prove our marriage) regardless of the initial "separation"?
