marriage to J1 visa holder

hi , was wondering if anyone could help me out with some info

my fiance is living in the USA on a J1 visa whilst our son and i have remained in australia.

i was wondering what the best way to go about obtaining a visa for us to go and live with him is, if we get married (which we have planned to do in the new yr) is there a limit on how long we have to be married before i can move over... im all in the dark about this. also what type of visa willl our son require?

any help will be greatly appreciated

As soon as you are married (or possibly even before, depending on the kindness of the international office at the institution where your fiance works), that office will issue both you and your son a DS-2019 eligibility form for a J-2 visa. Both you and your son will the obtain a J-2 visa to join your husband (your own visa will require the US consulate to see proof of marriage so he will have to be your husband at that point; there is no minimum time limit to be married before you obtain your visa). For your son, be sure to take his birth certificate to the consulate. Once you are in the US, you will be eligible to apply for a work permit, enabling to you work wherever you like as long as your husband is in valid J-1 status. Hope this information helps. Although the international office may issue your J-2 DS-2019 before you are married, you may not use it until after the fact, since you will be required to show your marriage certificate to obtain the visa.
