Marriage to GC holder

Hi Everyone,

I am sure this question has been answered quite a few times, so please bear with me.

I am GC holder for past three years and I am getting married few months to my fiancee in India. She is currently working in IT company. I am looking at different options like H1, F1 or L1 to get here. Below are few questions I have.

1. Would registering the marriage in India affect her processing H1 or F1 visa?
2. Since getting H1 is difficult these days, Is my US citizenship the only option I have to get her here?

Any other options are you aware of?

it would be tough to get a student visa..... H is an option... she can get a F before the marriage, thats kinda good option and when u naturalize , u can probably AOS

Marriage in India will make it impossible to come on F1 status (non-immigrant intent). If H1 is an option here, your best bet is to get her here on H1b visa (it has dual intent). This will allow her the freedom to travel and she would not have any trouble coming here (even with GC pending).

Your citizenship will be the fastest way to get her on the Green Card status. The wait time for the GC process as the spouse of Green card resident is more than 5 years. GC processing time for spouse of US Citizen is about 3-4 months.

Would suggest that you and your fiance really think this through.

is this 3-4 after the i130? or is it including the time for the i130? i thought that i130 alone takes like 5 months

For a straightforward case of marriage to a US citizen, the average case these days seems to be taking about 3-4 months for everything including the I-130.

does ir depend on the nbc or do, or consulate in india?

for me its nyc, vermont, chennai
