I got a ex-parte protective order against my husband and am trying to get him to agree to a consent agreement in civil court to get a one year separation agreement. We have been married for 8 years, have a 5 year old US citizen daughter and have been GC holders for 4 years. Will this kind of separation agreement be acceptable as grounds for divorce under the Hindu Marriage Act. Will this separation be valid if either of us go back to India, can I hold him to the clauses of separation like family maintenance money etc. if he decides to move back to India and I stay back here. Please advise, if my efforts will be fruitful in the US or do I need to conduct such a process in India.
