Marriage--RFE help

Hi all,

Today my lawyer received a RFE from USCIS on my wife's I485 application. The detail is "The USCIS is requesting evidence to demonstrate
that her marriage to you is bona fide"

We have already submitted our marriage certificate but still this RFE came in. Anyone else ran into this situation? any suggestions. My lawyer suggested to provide joint tax filing,bills, etc.,. All our accounts and utility bills are under individual names, we never felt to have our both names listed.

Any suggestions....

You can show mails addressed to both of you showing both live in the same place.

The lease document you would have is a pretty valid document you can submit. Also submit the tax return which would show ur wife as an dependent.

Do you have photographs that you both have taken together. Make some BW copies and send. If you have any digitals photos, make come color copies and send. Did you file joint tax returns? is the lease or mortgage in both your names? any commond credit cards? car registrations? Any of these will do. Also if you travel to your home country with your wife and if you ahve the ticket stubs indicating adjoining seats on the same flight, that will help too. Also even if you have the credit cards seperately in your names and still the bills come to the same address, that will help as well.
BTW, what does your lawyer suggest?
 
Documents for Marriage RFE

My wife got the same RFE and I submitted the following documents and got approved in 5 working days. As everyone say each case is different they may get approvals in different times.

I send the following documents to my attorney:

1) Joint Income tax returns for 2004.
2) Joint bank account statements and letter from bank that we have joint account.
3) Rental agreement which has both our names.
4) Utility bills on both of our names.
5) Car insurance policy on both of our names.
6) Same credit card on both of our names (Attached a letter from XXXx bank and copy of both the credit cards).
7) Same Health & Dental insurance policy on both of our names (Attached the photocopy of the cards).
8) Wedding pictures.
9) Marriage certificate.

Additional documents you can send (I didnot send these documents for the RFE).
1) Birth certificates of your kids which has both parent names.
2) Joint property documents like house,car etc.,
3) Both of your driver licenses copies if they have the same address that you have on your I-485 application.
4) Photographs that you took recently especially if you have date printed on those photographs.
5) Car registrations on both of your names.
6) As mentioned in the above post by Pwdg "Also even if you have the credit cards seperately in your names and still the bills come to the same address" not only credit card bills any letters like medical claims bills etc coming to the address which you have on file for I-485.
7) As mentioned in the above post by Pwdg "Also if you travel to your home country with your wife and if you ahve the ticket stubs indicating adjoining seats on the same flight, that will help too."


Any one want to add any of them, Please add it to the forum it will help others.

This is just what i send and consult your attroney and ask him which documents your attorney prefer.

You can submit baby's birth certificate showing your and your spouse’s names. In case you do not have a baby, how about giving a quick birh to baby? :D

Your Health insurance must have your spouse’s name.
YOur Driver's licenses must have same addresses.

You can affidavit from both your and your wife's parents stating that you were married on ... date ... place and they witnessed the marriage. In case they are not alive then an affidavit from uncle/ aunts, sister/brother should also be valid.

In case your wife's name is listed as spouse in your passport or/and vice versa than you can get a certificate from Indian Embassy or consulate to this effect.

They have already submitted marriage certificate, so INS knows they were married. Submitting aafidavits that marriage occured are not going to help. The purpose of the RFE is to see that they are STILL together (they may have separated, marrige could have been a sham etc.). THese queries usually arise if applicants were married less than 2 years before filing 485, or marriage occured aftwer filing primary I-485 and spouse was added later.

So any document showing that you are man and wife and live together CURRENTLY has to be submitted. People have suggested many documets for this, so submit whichever u can produce.
 
Hi,

Someone have suggested to get an affidavit from known US citizens for our "demonstrate marriage" RFE.

Could anyone suggest any format for the letter?
What should it say? should it be notarized by a lawyer? what information the US citizen should provide?/

Any comments would be helpful.

Who received the RFE your attorney or you? How many days after your case status was updated did you receive the RFE?
