Marriage, permanent resident and Cuban

Hi,

My boyfriend and I are thinking of getting married, I came to the US with a L2 visa which is now expired. He came to the US 13years ago in a raft, landed in Miami and was processed and got his green card.

Should we wait for him to get his citizenship, or can he petition me based on the fact that he is a Cuban refugee.

...anybody? Basically want to know if there's a difference between a Cuban with a Green Card and a Cuban with a citizenship. I read somewhere last night that marrying a Cuban with a green card your process can move faster than a US Citizen...if so I'm in luck...

Just talked to an attorney. He said that no matter my status, just by the fact that I entered legally I can be petitioned by my husband. He also said that taking in consideration that he is a Cuban refugee with a Green Card (Permanent Resident) the process should only take about 8months before I get my green card.
Can anyone confirm this?


The only thing is that we really need to prove that the marriage is not a fake one due to the fact that being a Cuban they look extremely well over this cases, which is not a problem.

your lawyer is correct for I-130 petition, but when it comes to I485, I don't think forgiveness to overstay is applied to Cuban LPR's spouse(Not refugee anymore), but there might be some special rules.

Did you tell all the fact such as
- You are overstaying.
- Spouse is a LPR. Neither a US citizen yet nor a refugee any more. Being refugee status and LPR is totally different.

And still did he say AOS is possible ? If that is the case, there is some rules for cuban's which I'm not aware of.
