Hello, I am a US citizen and I am engaged to be married to my fiancee in the Dominican Republic. We have been together for about 2 years. We looked into filing for a K-1 or K-2 visa but the wait is 12 to 18 months. We are now planning on getting married here in the US. He has a 10 year B1/B2 visa. I have looked over the forms to change his status & they ask what type of visa he came into the US on. I have been told that it is not illegal to get married on the B1/B2 visa. Is this true? Also, any additional help would be greatly appreciated.

Thanks.

It is definetly not illegal to get married in the US on B-1/2 status. However, USCIS can consider the AOSer guilty of misrepresentation at the visa interview and/or at the time of seeking entry into the US. USCIS frowns upon people who enter the US on B-1/2 visas with the intention of AOS. I would advise you to go the K-1 route. At the end of the day, it is your call.
