Hello,

I have a little situation, my fiancee and I planning to get marry soon; I am a graduate students and my fiancee already finished her degree and now work at the hospital but the hospital cannot sponsor her; I am a US citizenship and my fiancee is not.

My questions:
If we are marry, can I help her to change her status? and does this require sponsorship? The problem is that I am a graduate student, my income is not high ($7,000)?

Please give me some help...

Thank you

Her income can be combined with yours for the Affidavit of Support (I-864) if it's from legal employment in the US and it's not a short-term job like an internship.

The problem is that my fiancee is not a US citizenship is only allow to work in US for 1 year after she graduate (she already had a job, and her job cannot sponsor her). May be I am wrong but to file the I-864 require must be "A citizen or national of the United States or an alien lawfully admitted to the United States for permanent residence"

Am I missing something? Please if possible, give me some more detail...

Thank you

The I-864 has a section that allows adding the income and/or assets of the immigrant who is neither citizen nor permanent resident. See questions 24(b) and 28. You as the citizen would still sign and file the I-864.

However, if that job is just the 1-year practical training, it wouldn't be accepted unless she has an offer which extends her employment beyond that.

Thank you for your kind help; I just have one last question:

Lets say everything went fine, and my fiancee got the interview for her green card. Beside my fiancee and I require to present at the interview, who else is need to be at the interview? I am in a little strange situation because I have a strange relationship with my family, and haven't contact with them in awhile.

Thank again for your help

Only the two of you need to be at the interview. Even if one of your family members signs up as a joint sponsor, they don't need to be at the interview (I don't think they'd even be allowed).

You have the option to bring a lawyer.

My Egyptian husband said we are no longer married but we never filed papers for this anywhere.

We married in Egypt in 2006 the marriage has always been bad and this year I told him I dont want stay married.I am a US citizen he is Egyptian with a permenate green card. He told me we can live as room mate because we are no longer married throu Islam. So can this be true we did marriage in Egypt so can he divorce me based on Islamic Laws? He has not provided for me from the beginning and always mean so I want this divorce myself. Now that he has his green card 10 years he said we are divorced but wants to be room mates to save himself money.

What is the exact amount we need to eligible for the Affidavit of Support; Both partners together!!

Download I-864P which has the required income amounts based on household size.

Note that work income from the immigrant spouse doesn't count unless it's from legally authorized employment in the US.

Hahahahahahahahahaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaa! ;););)

This post made my day. I give it a Platinum medal for hilarity!!

Of course you can live as room mates with anybody.

This is not an Islamic scholars forum so we cannot advise you what is allowed or not under Islam.

I know we can live as room mates. I am asking is it really a divorce since in Egypt the divorce is excepted through the laws of Islam. So am I divorced or not? Can I be divorced by Egyptian Islamic laws since the marriage was performed there in Egypt.

If the divorce was officially recorded by a government agency in Egypt, and you have proof, the US government will recognize it. Otherwise, if the divorce was only an undocumented religious procedure, you're still legally married under US law.
