Marriage & I-730

Hi,

I have a question with regards to filing of I-730 and marriage of the beneficiary.
As per instructions I-730 applicant got to be unmaried while filing for benefit. Does it mean thet he/she be unmarried till the time of approval of their I-730 or they should be unmarried at time of filing only. In other words can they get married during the process time of I-730? As it takes years now to get the appoval or otherwise of their I-730.

I will appreciate any clarifications please.

To be elegible AND to be approved under I-730 derivate asylum, the beneficiary person MUST be single when the application is filed AND when the application is approved.

If the beficiary gets married while in the process of the I-730 this application will be void, and denied. It is just like the I-130 petitions for unmarry son/daughters.
There is NO derivative asylum for MARRIED son/daughters.

Think, before acting.
Wait til you get your derivative asylum approved, and then you can marry your love one. Now, for your future wife to immigrate to the U.S. you will need to become a US citizen.
Once you became a GC holder, you can file a petion for your wife/husband but it will take between 5 to 6 years for her visa to get approved and for her to come to the US with your benefits. She can come to the US with any other type of visa such as H.
The short and easy way is to wait till US citizneship and petition her/him.

The case will be denied if you get married before the I-730 is processed.

Also if you get married after your get your I-730 approved but before you get your green card you need to go throught an additional step to get your green card.

So much thanks for putting me wise on the subject. Infact this is with regard to my son"s I-730.
One more question if u do not mind. Will he has to wait one year after approval of his I-730 to file for GC like in case an asylee? He has already over 7 yaers residency in USA.

Unfortunately he does have to wait for one year from the date of the I-730 approval. The time before the approval does not count at all. Asylum green card cases are being approved pretty fast these days.
