I am on H1b working in US now. I got engaged in US and my fiancee is a US citizen. We are planning to do the marriage license and registration in US.

After I do the marriage registration. I want to know what is the process for applying for the Green Card and how long will it take to get the Green Card. I am planning to go to India in early 2008.

Each case is unique. It depends on your District Office (DO) which depends on where you live, and how fast your background check will be complete.

I think you need to do more homework before posting here. You can apply for AP which will enable you to travel, most likely even in early 2008 as you wish.

AP= Advanced Parole. You should apply for this so you can travel if you need to before your GC is approved.

It's up to you if you think you need a lawyer. Call around to see how much charge. If you can afford give it a thought.

I have a valid H1b, but I don't have H1b stamping. I came here on J1 then converted to H1b. i am going to do the marriage registration next month and religious marriage is going to be in india early 2008. Till next year we will be living in different state. do i need to apply for AP right?

I have checked with a lawyer he said it would cost around $4000 + filings fees. (for complete green card processing - I130, 485, EAD, AP) he said he will acompany me for the final interview.

Why not just get the H-1B stamp when you are back in India? Then return on the H-1B and file for AOS. You're much better off legally being here on an H-1B than being paroled into the USA.
 
If I apply for AP will it effect my Green Card Processing? Any way i wanted to get H1b stamp when I go to india. But I wanted to get AP for safer side.
 
No AP won't slow down your AOS. I guess getting AP as a back up for H-1B is an OK idea, I don't think you'll have any issue getting an H-1B stamp. If you do go to India and get your H-1B stamp, make sure you use the H-1B stamp and not the AP to re-enter the USA.
