Marriage date set 1/2/10-his H2B visa up 12/1/09! help!

Please someone help.

I'm going nuts here. We originally planned to get married 1/2/2010 as his employers promised they'd extend his H2B Visa, last week they changed their minds and aren't extending any of the H2B holders at his work. His Visa expires 12/1/09. I am waiting to purchase a home and need the time still for 1/2/2010... will waiting to marry 1 month past his visa cause problems for us in the future?

Know this.. we want to do things right but I need to wait til Jan to marry for tax reasons as well as other factors that affect our life. We aren't intending fraud but we dont want to risk him being sent home because of 1 month.

He's here from PI on his H2B since 10/07.
We have no bills together until we move in together next month as planned.

We will also be sending off our papers as well as the expedite process so he can get his card as soon as possible rather than months.

I'm stressing and I need some help.

First of all, you need to calm down. I recommed root beer and raw carrots to soothe your anxiety, plus beets. Are you a US citizen? If so, then he can overstay his visa till you kids get married on January 2, 2010. I would encourage you both to complete all the necessary forms (I-130/485/765/G-325a X 2, I-864 prior to your marriage, passport size photos for non-US spouse, 6 and 2 for US spouse, after you get married, a day after mail your forms priority mail to Chicago Lockbox. Include required evidence, proof of US citizens, marriage certificate, and all his require evidence which will be found on the application forms. He will be in the change of status category once USCIS issues Notice of Actions.

In the meantime, relax and prepare for your wedding, especially the honeymoon is it comes in the heard of winter.:D Lastly, your spouse to be should not leave the US till he has a greencard on hand or he might face a 3 year ban for overstaying his visa by 30 days or so. No honeymoon outside the US, the Poconos is known to welcome newlyweds...:D

What do you mean by 6 and 2 for US spouse?

Thanks for the list of documents needed, I wasn't aware of 3 of them so that will help definitely. This is giving me peace of mind and know that it will also calm him down as well.

Is there a list of questions that we should be prepared for, regarding our biometrics appt? I've read mixed info from people. From nothing is asked of them to odd questions that I wouldn't even know regarding my own kids fav color or so on. Amazing how you need to answer those questions for someone outside of our country, when you don't have to interview and know this regarding a marriage to another US Citizen. It astounds me.

No questions are asked at the biometrics appointment.

Amazing how you need to answer those questions for someone outside of our country, when you don't have to interview and know this regarding a marriage to another US Citizen. It astounds me.

You don't need to answer those questions if you don't petition your spouse. :) The reason for the questions is the rate of marriage fraud, which is also due to the amount of immigration law penalties that are waived for the spouses of US citizens.

passport size pictures, non-US spouse who is also known as a beneficiary should submit 6 and 2 for you. Please carefully review this link and educate yourself about this GC process, very easy process and will help answer a bulk of your questions. You future spouse will ensure you get the honey on the moon for all these efforts on his greencard escapades...;)

RC already answered questions on reasons for interview by USCIS, fraud is rife in the greencard for money scams. No need to worry about questions, biometrics only to ensure he's NOT a criminal and has no bad moral traits. For now, educate yourself about how to apply for the GC on your own, without the need of a lawyer except to have all ur questions answered by this discussion board.
