Guys,

I have applied H4 for my wife and son. I am in US and they are in India. Got query reg marriage certificate from Chennai consulate. I don't have one, so I had attached a affidavit.
Will the below mentioned documents be of any use, for resending
1. Ration card, where both our names are there.
2. My son's birth certificate, where both our names will be there (actually they had not seen this certificate, and asked for it again by oversight).
3. A form which I had sent previously, to get a new passport for my son.

If anybody have recently faced and solved this issue, please advice. "1mimi" had faced the same issue, but she had a Church marriage registration, which I don't have .

Sooner or Later you need to have a marriage certificate

ksc503b,

As long as you are in India, you do not need a marriage certificate. Chennai consulate may look at your ration card and understand that you are all one family and living in a particular address. Your ration card is not a substitute for marriage certifcate and does not certify that you are married to that person.

Presently you are in US, and you have to start thinkning differently.
Your sons birth certifcate may still say that you and your spouse are parents of the child, but does not say that your are married.

You need the marriage certificate to apply for GC (at I-485 stage).
When you visit India, register your marriage and ask the registrar to give the certificate in English.
If you do not have birth certifcates, start working on that too.
Good Luck

I am not sure if affidavits will work. Marriage certificates are relatively easy to obtain in India. If chennai consulate has asked for marriage certificate, better provide one.

Can I get the certificate from Indian consulate (which I can get, which I confirmed with the consulate) here or I heard there is Indian mission in India from where my wife can get?.
If I get this will the US consulate in chennai accept it?

US consulate will probably not accept it. You need to get it from the marriage registrar in India.

In my view only marriage registrar where marriage was held are authorised to issue marriage certificates.

thanks nkm.
I just now called Indian Consulate, and they said they can provide it and the US consulate in Chennai will accept it.
I am searching this message board to check whether anyone has said anything about the certificate provided by Indian consulate. I remember seeing one some time back.
If else then I have to go to India and register.
Do you know of anybody who have written about this?
