Somebody asked me something quite tricky. He had a marriage annulled.
Now he got remarried and filling for AOS. His wife is a USC. I am thinking he should disclose that he was married and got it annuled. Should it be disclosed in G325A?

My personal understanding annulment are just another name for divorce. One just sounds better. They say annulment means, Null and void and that if you remarry again you can say 1 marriage instead of 2.

His concern, they will grill him about it at the interview..like who is this lady, what happened? those kinds of stuffs....

This is not tricky. He should be honest in the forms. Tell him to disclose it in the form because they would know if he try to hide it. Of course, they will ask him questions why the marriage never lasted 1 month. Well, he can give them a reasonable reason like ....she was gay, and he got to know shortly after the marriage....

good luck.

Honesty is the best policy. He loses nothing by disclosing that he was married. Check out the link below from some who experienced this from this forum. you have to copy and paste the link for some reason it did not let me post the link by itselt so I put .... at the begining and end

It is always best to divulge about your past instead of letting the USCIS find it out by themselves. During the interview, your friend should be able to clarify the case and convince the Immigration officer. Then his application will be processed without any problem. By concealing the facts, your friend will end up messing the process.

Immigration background checks are more in-depth than regular background checks. They can see expunged convictions and annulled marriages.

Also, the citizenship application specifically asks about annulled marriages, so it's probably a good idea to mention it now so they don't see a discrepancy a few years later if/when applying for citizenship. He should remember to submit the annulment documentation with the green card paperwork.

What finally happened in this case? Can you please tell the result?
