I applied 485 in july 2001 and am about to apply my wifes 485 sometime by next week. My question is about the 30-60 day rule regarding the immigration intention of the applicant.. is it necessary to apply my wifes 485 only after 30 or 60 days of her entry into USA? what happens if we apply before that? Also would like to know whether my case gets delayed because of my spouses application. Will they be linked together now or treated as seperate applications. thanks for your comments in advance.

Got Confused

Where did you get this 30 - 60 days rule. I am going to do like you in March end. I believed I can do for my wife after arriving to US. Try to get the answer from Jim M or Martha.

this 30-60 rule of intent to immigrate came up while talking to a lawyer.... will you please let me know if you come to know anything about this. Also appreciate if you can tell me how to reach the people you mentioned. new to this place so.... thanks.. wil update wat i came to know too...

There is no such rule

H visa is dual intent (means, you can have intention of immigrating while applying or having H visa, this includes both H1 and H4).

Just relax, and apply 485 as soon as possible, because JULY2001 approvals right around the corner. They will be approving July cases any time within next 30-45 days.

Spoke to Jim. He echoes MILK\'s comment earlier. btw i happen to know him - for he helped me file my 485 last year... :)

Yep, that\'s what I said.

I also said he needs to apply NOW. If his GC gets approved before his wife gets her I-485 filed, she\'s in for a LONG wait. The filing for her would then be an FB-2(A) which has a priority date for India of 11/15/96!

Get this filed now!
