Marraige after citizenship

I am in the process of getting my citizenship.
Check cashed thru TSC on 12/18/07, waiting on NOA & FP dates.
And I need to work on marriage also, she is in india.
If I get citizenship in June or july, when I am able to bring her to USA..?
I know she gonna get conditional green card immediately, but I want to know
what is the approximate time for that 'immidiately'? one month or 2 months?
This is just to get some idea about timings to plan things properly..

After getting Citizenship, bring her on K visa (Fiancee) visa and get married in US. K visa should be immediate.

I know that option. But ideas r moving like wedding need to be happen in india. she really need to wait in india for more than 2 to 3 months if that is the case? that is the info actually I am looking for.
If this gonna not workout, I already decided to go thru K1.

Pal, when you get your citizenship you have to apply I-129F (if you want to bring her on Fiance visa) and the whole process from there will take about 6-8 months (current processing time) and then she can come here. Another option is to get married, and then you can file I-130 first and as soon as you got a reciept you apply I-129F to make her eligible to come here under Non-immigrant visa and as soon as she is here you apply for rest of the stuff.
Most of people in your situation will bring there spouses under fiance visa.

either way, it will take about 6-8 months from the date you apply.

You can get married in India and file for CR1 (spouse) visa after your return from India. The process takes more than 6 months but its less pain in the long run.

Thanx for good info. SO based on info provided by NIMCHE, we can file I-130
for spouse immediately after FP done but for I-129F, need to wait upto
get citizenship. I understood it correctly, I believe.
Is it normal to wait that much long after sent I-130?

Did I say that?
I-130 when you are married. If you are not citizen yet, you can apply base on your GC( for your spouse only not fiance) and when you get you Naturalization Certificate you can update it as you are a USC and then either apply for I-129F or wait till you I-130 to get approved.

So for a GC holder eligible for applying for citizenship in April 2009 who is already married (spouse presently outside the US), what is the best option?

1. Apply for hr GC now and upgrade when my citizenship gets approved (or do I just need a receipt of application)
2. Do nothing till citizenship
 
With current processing time and all the research which I have done( I am in the same situation as you described above) I found it much better for myself to apply as a GC holder and then when I get my NC I will upgrade my I-130 with a service center and I will also apply for I-129F. It should be a smooth process I hope so and I will let you know. BTW you are not applying for her GC by applying I-130 on her behalf, but you are just applying for an immigration petition for her which make her able to apply later on for AOS when she arrives here.

DCF, K3 - GC Holder Spouse Options

Hi

Some questions

1) For DCF option, should the marriage happen to an US Citizen, or a GC holder can marry and do the DCF after the GC holder gets US Citizenship?

2) For K3, what is the advantage of "applying for I-130 as GC holder and upgrading it to I-130 as US Citizen" versus "applying for I-130 as US Citizen"? Will the I-130 priority date still hold when the updgrading happens? Can the older I-130 receipt be used when applying I-129F? Or, should the receipt for the upgrade be used when applying for I-129F?

1) Only US, that would be easy way pal for a GC holder. I would be the first one to do it, standing in line.
2) I can say you are ahead about 1 month processing time, somtimes 10 days. and I think you can use the same recept for I-129F

Hi All

I got my USC recently. I am about to apply for I130 for my wife who is currently residing in India. My wife is an IT professional and has got H1b this year.

1) Will the I130 filing cause any issue when my wife goes for visa stamping? (She got L1 stamping a few months back when I was an LPR, but she didnt travel as the project in USA was downsized).
2) Can I apply for her K3 as well? Will that affect her H1b visa stamping? Will it be faster than her H1b, and does K3 has advantage over H1b? Is there a website for K3 tracker?
3) Can I apply for concurrent I-485 without her presence here in USA?

A1: Her H-1B visa should not encounter problems just because an I-130 is in the works.
A2: You can apply for a K-3 too, but I doubt it will be quicker than the H-1B.
A3: She needs to be in the US for an I-485 to be submitted.
