I have a labour certificate clearance and my company attorney wants me to go ahead and file for 140 and 485 concurrently ASAP. The issue is that i am still single and plan to get married by the end of this year, or early next year. At the same time i dont want to loose any time in the GC processing. is there a way out ? can I file for both 140 and 485 and then include my spouse's name later on when i get married... what is the right approach ?

Thanks in advance,

Easy way out

Pick a bride who has a GC already. You will get yours before any of us here. :)

You can file yours now and file hers later. It is better to start your application now, don't wait.

u r wrong dude. if u marry a GC holder, u r stuck... u shud be marrying US citizen instead...

Thanks a Lot Guies,

That really helps !! Well i Believe TSC is taking about 2 & 1/2 years to get a 485 processed. Does anybody know of a case being approved in about a years time?

Appreciate your help.

File 140/485 together get married after 140. If you have time left on H1b visa - get her on H4 and apply her 485. Else get her CP done, on intent to join.

Hi Captainr,

Thanks for the source.

From what I gather by reading through that source and some other sources, it appears that the application fees is going UP effective 04/30/04.

Did you know about any specific reason for NOT applying untill that date?

Rates up

However, processing will be completed faster. At least, that is what the news said. Keep in mind, I did not read this information somewhere else, so I am not sure how accurate it is.

Similar situation

Hi amazing_run,
You have the similar situation as I was one year ago :)
I got my labor last year Feb, and file concurrently I-140 and I485 on last Apr (I was single then), then last Nov I got married, and add my wife's name on the I-485, filed her case this Feb.
The point is: As long as you get married before your I-485 is approved, you can add your wife's name on your I-485 case and you two will get the green card at the same time.
Some people said: add your wife's name later probably will delay your GC processing, I agree, but won't delay too much, maybe several months.

Best wishes for you to get married before your I-485 is approved!

Hai
