Marrage breakdown & pending 485

I was on K1 visa uk citizen ( took a year to get ) , married in march 2006 . Marrage broke down in july , various reasons, I left , I know is not long , but was good faith marrage . I have work permission , social number , and advance parole . Wife now threatening to cancell 485 unless i return to her . Was not sham marrage , but cant go back to it . What do I do , advice please .

You can go to your lawyer and do the petition by yourself because on the law when she is threatening you with the documentation and that is violence domestic. You will need a lot of evidence, but my recommendation is go to your lawyer and tell him everything that she is doing. You maybe do not need her.

That's not domestic violence at all. If he abandons the marriage, she has every right to cancel the immigration petition.

I'd be making plans to return to the UK.

well if you knew the issues , you may not be so quick to Judge ............
 
Leith49 sorry 2 hear abt ur situation, but what the RealCanadian says is right and thats how US immigration laws work. You only get derivative I-485 benefits as a spouse of the main applicant.

I am not "judging" you. I am merely telling you what your options are. Unless you have documented proof of abuse (eg. police reports, etc.) then you have no basis upon which to get a Green Card.
