Marital Status - for GC sponser

Marital Status? - Divorced Sibling

I am a US citizen, finding sponsership(GC) ways for my sister as a brother. I have a basic question about my sister's marital status.

1. Is a divorced mother considered as "single" or "married" for application purposes.
2. My sister is a single mother(divorced, age 38) with children. What category can I sponser her. How long does it usually take.

Can someone guide me in the right direction. Thank you.

You can sponsor your sister as immediate family . Please check the processing time at https://egov.immigration.gov/cris/jsps/ptimes.jsp;jsessionid=bV35_4gS6aFe .

Depending on where you file your petition and the priority dates , you are looking at a few years (usually 5-8 for family based sponsorship - sister over 21 years)

Regarding the legal marital status - I really do not know . I do remember a question on the 485 / I-130 form where all marriages had to be declared .

If the divorce is closed and finalized then she is considered SINGLE,

Family based sponsorship and as ps182 cmentioned it can take several years, Is she in USA now & if so did she enter the country legally? That will have a huge bearing on whether she can apply for LPR.

She would get her GC quicker if she was to marry a USC, of course with her currant status as a single morther that may not be in the best interest of her children.

I think it would be a good idea to go into an Immigration Attorney and ask for an intial inquiry then ask the attorney what options you have, and which way is the best route,

Addie_Goodvibes: My sister got her divorce (in India) granted by court judge (basis was cruelty and dessertion - this was written on court divorce decree - this is what in exact terms, what she had gone thru all her life so far).

Right now she is still in India. She has a Bachelor in science. Thank you all for giving replies to my question.
