Marital Status change during AOS

Hello gurus,

Got in a pixie situation. Filed my 485 and am waiting for approval. (Past 18 months). During initial filing of 485 was single and there was no name to enter for the spouse. Now, was on EAD, AP and 485 (AOS), I got married to my love (sucessfuly on the boat at the right time)

a) Now, is it imperative that I change the Marital Status on 485 which is pending?

b) reason being, doing step a) would in turn help me with my follow-to-join process (file I 824) after 485 approval.

c) If I dare not mention the spouse or change the status to Married from single will that be a cause of concern.

(One reason I fear is by initiating a change of staus I might create unncessary delay, and it might take longer than it is taking right now for approval -- my allayed fears which I cannot keep them to rest about INS)

I highly appreciate any and all input in this matter.

I think that it will be a bigger problem if you get GC first

and your spouse doesnt. she will need an independent visa for herself if she wants to come here and the dates become current etc etc.
Much headache...
My 2 c are that if one gets married, have the spouse on the application asap. Nowadays, there is no guarantee of a delay or faster approval either ways and you save on a lot of tension and separation for a prolonged period of time.
 
I would advise you to get your spouse as a dependent ASAP!

Better to wait for your 485 a little longer, with your spouse, as compared to wait alone for much longer without.

And as mentioned above, there is no guarantee of delay!
 
I was in the same situation as you are in. I successfully got married and bought my wife with me, while my AOS was pending, even got her EAD approved.

My advice to u. Don't use the FTJ option, if you still have your H1 still. FTJ can be painfully long.
 
But I am using my EAD

So, I am using my EAD and I cannot bring her in. How can I add her to the application that is submitted.

I was on H1 but had to leave. So, now using my EAD. The only option that I have is to get her via FTJ.

even if you are using EAD u can still

even if you are using EAD u can still get a H1 (maybe use premium processing) and go to india to get h1 stamped and also the h4
 
Cannot revert back to H1

Hello VASX6,

I believe that I cannot revert back to H1 once I start using EAD. So, what are the other alternate solutions.

Apply H1 for her.

If she is qualified and you are working for a company, which listens to you, then Get her H1 done for her from your/ some other company. Bring here immediately and apply for AOS.

Or

Apply FTJ and wait.

It is difficult situation.
 
EAD renewal

I need to file for my EAD renewal and do you recommend me saying that I am married because the last renewal was as single.

So, saying married even though you dont have it on 485 application will cause any problems? And she is not here right now in US, what are the repercussions?

Suggestions please.

thanks for the help till now but need to know if I have to check married even all my previous applications have been marked single.

Did anyone have to go through this? Please share your comments. They are highly appreciated.

If you are married, you need to check married, because it's the truth. It won't make a difference to your adjustment application one way or another. Making a false statement, on the other hand, can cause IMMENSE problems.

I'm not going to overstate things. The risk of detection of such a thing is extremely low, but the ramifications are high. Since it won't make a difference, just tell the truth and sleep at night.
 
Yes you need to check as married now. It does not make difference as for as processing is concerned. So many people get married while in the process of GC. It is not going to heart your processing in any way.

If you write not married you will be lying.
