Just spoke to IIO reg.my I-140 file being sent for CP without my knowledge. Since I chose AOS route my lawyer didnot do a good job of intimating at the correct time.So here I am victimized. But the nice IIO lady spoke to me saying that my case is not yet opened but will be delayed because my I-140 file is missing. And it will take more time maybe month(s) to get back from consulate(note: not via NVC ).
