March 02 still waiting, Frustrated, thinking of giving up and moving to canada

I am so frustrated, not only with TSC but also with my attorney, she is doing nothing. I always have to force her to inquire about my case, now she wanted me to allow her to renew my wife's AP and EAD so that she can get some more money from my comapny. I refused, because my AP is pending with TSC for almost a year and has not been approved yet

Here is the story:

ND: 03/21/02
FP: 04/01/03
RFE acknowledged by TSC on August 11, 2004 (regarding SR issued by officer 374)
AD: 98 days and still waiting.........?
Last Update changed for both my I-485 and AP, which I filed about 11 months ago to 11/16/2004, but text still the same for both cases

AP: filed on 12/03/03, almost a year ago. It transferred to local office on June 17th, transferred back to TSC on September 7th; they issued RFE regarding SR (which Advance Parole never needs according to so called LAW). RFE was acknowledged by TSC on October 19th, but still its not approved.

However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.

Send 2 letters to Senator, two letters to area representative and several faxes to TSC, called TSC and they wanted me to wait for 30 more days before they transfer me to Tier 2 customer service


Any suggestions/comments?

You got nothing to worry about. It seems your approval is around the corner. I believe many folks here have even worse situation. Many 2002 filers haven't got 1st FP notices yet (including myself). Just find ways to enjoy your life. We all live in an unfair world. Try to adapt to it, if we can't escape.

I also got a friend and thinking of moving to Canada. Good thing we met a new friend who is from Canada and advised my friend that USA is much better than the latter. US offers a greater opportunity of course, although waiting for I485 approval is nerve-wracking but Pardeshi1 is right, you're almost there and it's cold in Canada :) Cheer up! Although I can't cheer up myself due to this long I485 ordeal... :(

I am also in the same boat - frustrated and diasppointed

You are not alone. We also feel the same. I got info from the congressmen's office that My name check is still pending. I tried to contact the FBI. Sent a couple of faxes and an email a month back to FBI. No response yet. Unfortunately, the most frustrating thing is that - We can't ask anyone about the delay. Not sure how long we have to wait for the name check to be cleared and then how long it will take for the CIS to approve the petition. And those who filed their application almost 18 months later than ours are getting it approved and I am still in the same situation for the past three years. Very frustrating and disappointing. Whey is the system so unfair? Unfortunately we have to just grin and bear I think.

we can feel ur frustration but giving up at last movement won't worth u, if u still have open door in Canada, we advise u bare littlte bit more . our prays are with u :D

You know like every state has cogressman and Senaters. Try to contact a congress man . They might enquire about the case. Is your name check completed?.
 
I came from Canada!

Most of the young folks there want to come to USA. Canada's economy depends on US economy. Less salary, expenses are like in US and more taxes and very few oppertunities. You don't always work on latest tech. jobs. I never hated it but compare to US, life is dull.

Life is bit safer and it is good for retirement though. Gave up canadian PR and waiting frustratingly.

My case's ND/RD is in March 2002 too. I don't even do FP yet. How can I do? I tried to push my lawyer to make inquiry to USCIS and he told me I was boring him. It seemed he wanted to charge me.
 
Yes I sent several letters and Name has been cleared from FBI

Yes, I did send letter to my Senator a month ago and they wanted me to call today to find out the status of my case. My name has been cleared from FBI almost a year ago. I also sent a letter to my area representative about three weeks ago, for which, he got response from TSC that they issued 2 RFEs one in july and other in August and they have not received any response. I do not know why people over there working for TSC are so irresponsible and do not take time to check their database, becasue according to thier website they did receive a response on August 11, 2004.
After receiveing this letter from the representative, I called TSC and inquire about my other rfe and a nice laddy told me that they never issued two rfe and she also varified that the only rfe isseud was on August and it has already been responded. Then she suggested me to write a letter to TSC I-485 department, which I did, after that "Last Upodate" changed to 11/16/04
 
"Intent to Deny" issued on both I-131 and I-485

Today I received e-mail from my attorney and she informed me that on both of my cases "Intent to Deny" notice has been issued. They want me to come for an interview in local office and discuss this with the immigration officer.

Strange thing is that they already received all the information through my attorney and now I have to take the same stuff with me "personally" for this interview.

Cause of "intent of Denney" is that I never appeared for "Special Registration". First of all, according to immigration law if some one enters on Advance Payroll, he/she does not require SR even though they are from SR countries. Secondly, I did go to Local office for special registration just to make sure that I do not need it. After waiting in line for more than 3 hours, I was told by the immigration officer that I do not need SR. I requested the officer to write this down on a piece of paper which he refused to do so.

I informed this to my attorney as well as wrote a letter to Local Immigration office and never received any response from them.

Now, I have no idea what the hell they want from me

Hang tight. Don't worry, you will be alright. Talk to your immigration officer. Since you have all the documents I don't see any problem. Good Luck with the interview. If possible, drag your attorney to the interview.

Finally they registered me

I went to Local office and spoke to an investigation officer, she told me the same that I was not supposed to register. Anyway, she registered me in the database yesterday and I faxed all the documents to my Attorney. Let’s see what happens now?
