***Major Set back *** - Packet 3 and Visa Fee to be paid in US from Jan 1\' 2002

I just spoke to an officer in NVC and she said that they have changed the rules...

NVC sends the packet 3 to the attorney.
We fill the packet 3 and send it to Missouri (Dont know what the heck is there in Missouri) along with the fee.
Missouri will collect money and send the packet to NVC again.
NVC reviews the packet and forward it to consulate.

This whole thing would delay the processing I guess....
 
The State Department has a processing office in St Louis, MO...

that\'s where we get visas revalidated. Maybe, that\'s what she\'s referring to.
 
New Process

My I-140 approval notice received at NVC Dec 10. Not created case yet even after 10 days. When I spoke to the operator she says it\'s due to this new process and they won\'t create a case or P3 until the new rules come into effect.

This is bad news. My lawyer says under this "new" process (which is already followed for Canadian consulates) it takes 6 MONTHS to schedule the interview.

Does anyone have more information?
 
12 months more likely.

NVC will scrutinize everything instead of each consulate doing their own thing. Delays galore.
 
No Title

This is a bit confusing. Does it mean if my Packet 3 and interview date have been set up I am OK????
 
Don\'t Panic

You should wait for DOS / NVC confirmation on this before reacting to information like this. The change should be plainly evident when you get your P3.

Anyway-

This is the same process that has been followed for consulates such as Montreal for quite some time, and there really isn\'t much difference in processing times (maybe an extra month, but that\'s not definitive).

Hopefully the NVC is geared up for the added workload, but I doubt this will result in the absurd delays mentioned above.

If you\'ve already sent the consulate your P3 forms, presumably you are OK (read the effective date above).

except for that DOS memo about eliminating packet 4, does anyone have better info? Like, where did you hear about P3 sent back to NVC?

Yet, I am sure that anyone which had received old P3 already, is "safe" with old system.

It remains to be seen what will happen with AC I140.

Designation of Certain Posts for Special Fee Payment Procedures

    This public notice adds additional posts, located in India and
Vietnam, to those already designated by the Deputy Assistant Secretary
for Visa Services for two purposes related to the payment of immigrant
visa fees. The first purpose relates to the revised procedure for
payment of the fee for the processing of the application for an
immigrant visa set forth in the Federal Register on September 8, 2000,
(65 FR 54598). The effective date of that notice was stayed until
January 1, 2001 by a public notice in the Federal Register of December
14, 2000, (65 FR 78243).
    The second purpose is to identify the posts for which a fee
pursuant to Item 61 of the Schedule of Fees for Consular Services (22
CFR 22.1) will be assessed for advance review of and assistance with
the Affidavit of Support that is required in certain immigrant visa
cases. Notice of this fee requirement was added to the visa regulation
pertaining to the Affidavit of Support requirement in 22 CFR 40.41(b),
and was effective January 1, 2001.
    The Department will publish further public notices as additional
designations are made.
    The Deputy Assistant Secretary for Visa Services has designated the
Foreign Service posts in the following cities for participation in the
new immigrant visa application processing fee payment system and the
fee for review of and assistance with the Affidavit of Support required
under section 213A of the Immigration and Nationality Act. The
effective date of this notice is October 1, 2001.

It is still confusing....

My lawyer stinks. Can anyone clarify if this change in rule applies to P3 and cases already created and I140 despatched to consulate.
by NVC. Is their any cut-off before which our P3 should reach consulate or is it immaterial. I mean old cases for which P3 has already been created should follow the old process of sending the completed P3 directly to Consulate...
 
AC-140 procedure ???

Do all these changes impact the AC-140 procedure or does the AC-140 process needs anything to do with NVC.
 
Clarification re: new process

I checked with my lawyer\'s assistant who spoke to NVC:

My I-140 petition was received at NVC Dec 10. but case has not yet
been created. For cases like this, NVC will NOT send P3 until "early
January". These cases will follow the NEW process.
