Maintenance of Green Card Issues-- Certain Clarifications

Hi Rajiv,

I have some misconceptions reg Green Card. I am a Green Card Holder. These are due to difficulty in maintaining my family ties in U.S. as well as in India.

1) Under what circumstances ( period of stay abroad ) of staying outside U.S. a G.C. holder is deemed to have abandoned the G.C. status ?

2)Is it correct that a Green Card Holder can stay outside U.S. during the first trip ( after receipt of G.C. ) upto a period of 2 years with Re Entry permit in had otherwise only upto One year without the Re-Entry Permit.

3)Can under any circumstances a G.C. holder get more than one Re -Entry Permits ? If so are there any restrictions for obtaining the same ?

4)Is there any stipulation that a G.C. holder has to stay for a minimum period in a year during the currency of the said G.C. for its maintenance ?

1 year without a reentry permit

2)Is it correct that a Green Card Holder can stay outside U.S. during the first trip ( after receipt of G.C. ) upto a period of 2 years with Re Entry permit in had otherwise only upto One year without the Re-Entry Permit.

On any trip a GC holder can stay outside the US for the validity of his reentry permit - 2 years. If he gets a second reentry permit, it's usually good for a year.

yes, do read the instructions on the reentry permit application form

4)Is there any stipulation that a G.C. holder has to stay for a minimum period in a year during the currency of the said G.C. for its maintenance ?

if you stay outside the US for a period of less than 6 months, the officer is the one who has the burden of proof that you abandoned your residence. If you stayed more than 6 months - the burden of proof is on you (that you still reside in the US). If you make lots of 6 month trips, eventually you will be questioned about it and may lose your GC.
