Maintaining spouse PR after 3 yrs

I had a question about maintaining PR after the 3 yr limit is reached. I understand that at that time you have to enter Canada and stay there for two years so that you don't lose your PR. My question is

1) Since my wife is a PR would she also require to stay in Canada so that she does not lose her PR, are we seen as two separate PR individuals or does my staying in Canada satisfy her requirements?, I am guessing not but wanted to verify.

2) In the event that she does not move to canada at that point and she loses her PR what options do I have, do I have to wait till I complete two years in canada and then an additional year to become a citizen and then reapply for her permanent residency/citizenship? Is it easy or are there any issues,are there any other options?

Thanks in order for me to sponser her again do I have to wait till I become a citizen which means three years or can you sponser that while you are a PR?
 
Srini,
Once she looses her PR she can reapply as a skilled worker or family based immigrant. Once you become a citizen you can sponsor your spuse or child even if you are outside Canada under certain circumstance. See attached PDF.
 
If your wife looses her PR status the best way to get PR is for you to sponsor her. It takes on an average 6 to 12 months (in India) for the whole process. Dont even think about applying as skilled worker - the process is too long.

You can sponsor your wife (and any children) as a PR - you dont have to wait to be a Citizen. There is no income requirement but the only condition is that you have to be present in Canada to sponsor your wife.
 
Thanks a lot guys that really helps me a lot it does make sense to just sponser the sponse and not try the skilled worker method.

My only concern is that we both have PR at this point and she might have to stay back in the US while her US GC is getting processed and I need to enter Canada within the three yr limit to avoid losing my PR. If she does not have success in getting her US GC then I would need to re apply for her PR in Canada and at that point would the canadian consulate view her having the PR earlier negatively and reject her application?

Has anyone tried this if so please share your experiences.

I am sorry I did not understand your statement, in this case she has finished landing with me and this is after three years that I am referring to.
 
After you land, you have to stay 2 yrs out of 5 years in canada to keep your PR, So your wife after landing can still be out for 3 years and be a PR of canada.

I believe you and your wife have stayed out of Canada for almost 3 years after becoming a PR, correct?? Now since you want to mantain your PR, you went back to Canada while she is still in the US since her US GC in process.. correct??

Well, I am in the same boat as your wife. I need to decide now if I want to stay here and wait another 2-3 years for the GC or move to Canada in the new few months..

I think your wife would have move Canada before her 3 Yr limit to maintain her status.

Thanks for your responses, Desi what you said is exactly right but here is the point that I want to find out, say I decide that I want to go to Canada so that atleast I don't lose my PR at the end of the three yr limit but my wife wants to stay back since she is in the last stage of her GC and leaving that and having her move to Canada would mean the whole US GC process went to waist hence the question was if I did move to Canada to keep my PR, my wife stays back to continue her GC and let's say for some reason her US GC does not come through at that point she would no longer be a canadian PR so can I sponser her at that time again which based on the responses above is possible but then the bigger question is will that be viewed negatively by the Canadian immigration authorities since she just recently forsaked her Canadian PR and now is getting re sponsered by me?

That is my big question, can anyone share their opinions on that?

The only aftermath that you will have to face would be that if your wife's GC falls apart or she is laid off , She will have to go to India and it would take appx (1 year) for her to come to you unless you have some other plans in mind.

That is true but at that point we would have decided not to pursue US GC anymore and just settle in Canada and I would have to start sponsering my wife at that time and I wanted to make sure that I could do it again without it seen negatively by the canadian authorities since she just lost her PR and now I am reapplying it for her again

If I were you I would let your wife take a chance and stay back however I would definately move to Canada. This way you would be covering both the bases eventhough it would mean that you and your wife may have to be apart for some time - worst comes to worst - around 1 year if she does have to go to India.

Anyhow, thats just me.

When does your 3 year limit end ?? Just curious, not nosy. Just want to find out if theres' somebody else with me on the same boat.
