Hi,

I am on H1B at MD based company. I am on my 6th year of H1 and have my labor certification application at BEC. I am thinking of going to school full-time starting next fall (2007).

By the time I go on F1, I will have no time left on H1B. After finishing the school and an year of Optional Practical Training, will I will have to leave the country. what would be a good option for me to study full time with out affecting my green card application?

1. Can I work part-time on my current H1B, so that my green card application does not change? That way I can still go to school part time.

2. If not, then can I get a new part-time H1B, sponsored by the same company. But then I am not sure, what this will do to my green card application?

Thanks much!

There is no need to be employed to keep gc process. EB GC is for future employment. I f your sponser agreed to keep your GC application and had intent to hire you after GC gets approved, you can keep it w/o being working.

you can not get H1 after F1/OPT if you already spent 6 years unless you left the US for a year.
