LUD's after RFE Reply.

I received an RFE for my I-140 on September 1st.My Concurrent Petition is on a Preapproved labor.The RFE was about USCIS wanting a copy of the original Labor Certification.The Original Certification is Lost and we made the Petiton on the basis of the Duplicate Copy(not certified) sent to us by the DOL.My lawyer replied to RFE on 21st september.VSC received it on september 23rd .There was an LUD for I-140 and I-485 on the same day and i received the following mail from USCIS(the same as the Status Message):

On September 23, 2004, we received your response to our request for evidence or information. It is taking between 90 and 485 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.
======


Yesterday (09/27/04) of the I-140 LUD changed again but the Status Message remains the same as above.I have not received any Email from USCIS .There is no LUD for I-485.

Any indications or inference from the above?
 
None whatsoever. In fact expect it to change daily for few more days and then silence until the approval. My RFE response was rcvd on 12th August and LUD changed daily till the 17th and I have yet to hear anything at all. RFE was an education RFE. From my instincts you may even get approval within 2 weeks.

same here guyz! RFE received on mid week in Sept and LUD changed bunch of times and silent till now! anxiously waiting!

earlier people use to get approval an average of 2 to 3 weeks after submitting RFE, let us see what happens.

VSC is on roll for approving 485, may be this is the reason for I-140 delay!

I believe "Kishore_i" and "kamvp" is also in the same boat!

RFE issued 6/16/04, reply received on 6/23 (Although we never received the RFE), then LUD change everyday for 7 days till 7/1 on 140 and LUD change on 485 on 6/24.

LUD change again on 7/27/and 7/28 for both 140 / 485.


No LUD change after that. On line message changed on 6/23 only.

Got a copy of 140 using FOIA, sent by USCIS on Sept 10, The action block section is blank, indicating no decision has been taken yet on 140.

Long boring and frustrating wait.

PS - Mine is the case where pending 140 was withdrawn by the employer on 3/17/2004 against which I sent the AC21 letter taking shelter of 180 days clause. 4 months after that I got 7th year H1 extension using pending 140. The case is still open per the online status as of writing this mail.
