LUD on 485 After Invoke AC21

I am seeing LUD on 2/6/08 on my pending I-485 after I invoke AC21 and sent AP application in last week.
Please shed some light on this. Is this normal? I also observed LUD on 2/3/08 on my wife pending I-485.
 
Yes it is normal. Did you also change attorney on file?

Can you please send me the format letter as I just changed jobs and would like to use AC21. I am not sure what all documents that I need to send along with that. Thanks
 
G-28 revocation.

Hi LaborBadhi,

Did the pre-formatted letter include revoking your previous attorney's G-28 authorization as well?

I too am considering invoking AC21, but am still not familiar with the process completely.

No You have to use G-28 seperatley.

Here is the sample letter I used:

On January DD, 2002, my I-485 application was filed
based on an approved I-140 by my former employer, ABC,
Inc. In Aug/Sept 2002, I began lawful employment with
XYZ Inc, pursuant to the Employment Authorization
Document (EAD) issued on my behalf in conjunction with
my I-485 application. I am currently employed in the
same field as my previous employer, ABC Inc., and in a
similar position.

The American Competitiveness in the Twenty-First
Century Act of 2000 (AC21) allows for a change of
employer on any I-485 Adjustment of Status Application
that has been pending for 180 days or more, without
the need to file a new I-140 petition. (Attached for
your reference are relevant portions of AC21.) In
Aug/Sept 2002, pursuant to these guidelines, I changed
employers from ABC Inc. to XYZ Inc, as my I-485 had
been pending beyond the 180-day period required by
law.

In light of the above, I maintain that I have lawfully
changed employers pursuant to the AC21 statute, and
that my I-485 application remains valid. I
respectfully request that your office should
adjudicate my I-485 accordingly under AC21 provisions.

I just sent AC21 letter, I-485 receipt and employer offer letter. That's all.
 
G-28 is the form that one fills out authorizing the attorney to represent your case on your behalf. When invoking AC21, it may not be a bad idea to revoke the G28 authorization too, as this will eliminate the possibility of your previous attorney cancelling your I-485.

Stoned Ant: your response is a super important one. Always Always revoke the G28. I have seen other folks who have been really screwed since the RFE's were not responded to in time.
 
I'm planning to retain my old attorney. The new company agrees to reimburse any reasonable expenses I would have to pay myself. In fact, the new company __recommended__ to retain my old attorney, saying that G-28 updates are way too slow to rely on.
 
There has been a flood of LUD (rhyme! :D) on the I-485s in the past week. I got one, and my case was approved last year summer.
