Loving husband father to be deported

My husband was brought here to the US when he was only 14 days old, his parents were both legal resident aliens residing here in the US at the time of his birth. His parents were lower working class at the time and did not have the money to pay for the hospital bills for him to be born here so they decided to have him in mexico. Early last year he developed a physical illness and the medications for his treatment are almost worse than the disease it's self they cause him to have hallucinations and disorientation. I have been trying to get help for this everyday for this last year and no one could help us. Now a man has taken advantage of my husbands disability and landed himself and my husband in jail. This man is a predator through and through no matter my efforts to keep this man away and warn my husband that something is just not right about this man I would still come home to find this guy about my house talking to my husband. He told my husband that his car had broke down and he wanted to pay him to fix it, my husband has been working as a mechanic for over 25 years so he agreed and went with the man to fix the car. I came home to find my husband gone and not 5 minutes later the police were at my door. Apparently this car did not belong to the man and neither did the house, the police have impounded my brand new jaguar and charged my husband with felony burglary along with this man. They tried to say my husband stole the tool box he had from the house but when they asked me to confirm whether this box truly belonged to my husband i found that it did in fact belong to us because i had just bought the tool box for him for xmas. However my husband is still sitting in jail awaiting a preliminary hearing. I explained to the officers about my husbands current mental state and they said they believed he was intoxicated but would run a test to make sure. They gave me a paper on how to get my car back after a 30 impound, and informed me that because he is not a us citizen they would have to inform immigration but because this is a felony he would 90% likely to be deported. My husband has always been a good honest hard working man and had his own businesses up until he got sick, we have 4 children and one on the way, can they really take him away even though he is mentally incompetent? Due to a medication the doctors refuse to change or help us manage? I can't raise 5 kids on my own I am a Caucasian American citizen and have no means of being able to move to mexico and care for my family on top of that mexico cannot properly treat his disease. As it is we only have speculations on his time with us before he will succumb to his disease doctors say that he has maybe a few years left and that is being optimistic what can I do to keep him here with his family for the duration of the time he has left?

Do you know if his parents naturalized before his 18th birthday?

AZ_MOM,

You need to identify his immigration history. Has he got a greencard? File a FOIA request to obtain a copy of his immigration A-file, use form G0639 from www.uscis.gov under TRACK 3 processing. Request an expedite.

You need to talk to his parents (or find out about them) and determine if they naturalized before he turned 18.

You need to find out the exact State criminal charges in the case to determine deporatbility. The cops don't have a clue about that.
