Lost Passport with H1 stamp!! Jaxen/Jim Gurus Please Help.

I have been living in US for last 4 years on H1 visa, my wife on H4 and I have a 2 year old son who is US citizen. I cam for a 2 week vacation to Delhi and someone stole my LAptop bag which also contained my passport, original 797 etc. I informed US consulate of the above incident and the Lady at information counter told me to reapply for a fresh H1 stamping and to get a new original I 797.
What are my options here?
1 What if TSC takes a few months to issue new 797. They have cabled the old 797 which she says is not acceptable.
2. Can my H1 be rejected this time, though I got my revalidation stamping done just a month ago from St. Louis
3 Should I send my wife and son back to US , before I apply?
4 Do I need to carry everything with me, like a new approval cos lot of my documents are at my home in US (degrees, marksheets, evaluation etc)

Has anyone else gone through the same situation.
Any advice / Please help.

1. If TSC takes time, you have to wait in delhi. Heard of premium processing?
2. No chance of H1 rejection
3. You can.
4. If consulate asks you might have to. If US consulate asks for those documents, then you have to produce them right. You can ask your neighbor to do this.

Have you tried the option of filing for a duplicate H1 approval (I824?). I think you need to talk to your lawyer.

My H1 was done under Premium processing at TSC in October. My lawyer has already requested them for a duplicate approval without filing 824. He says if they ask him to file 824, they will take a long time bacause they are in 4 month backlog. The Officer told him "he will see what he can do"
Can I use the I 797 copy that goes to the employer?
Can you do Premium processing of I 824?

No U cannot do a PP on I824.
You can always try with a certified copy or the employers copy (and a police report)

Thanks for your input.
I am also a Canadian Landed immigrant. I went to Canadian consulate in New Delhi and got my Permanent Resident stamping on my new passport yesterday. Will it be better for me to go to Toronto and wait there till my lawyer gets another I 797, and apply hor H1 to US Consulate in Toronto or wait here in Delhi and apply here, since I lost everything here in Delhi ?
Is one place recommended over another in this scenari?
