Lost I-94 few years ago! Please help!

Good Morning everyone!

This is my case. I am a U.S citizen and I recently got married. My husband lost his I-94 about 10 years ago, and has no record or copies. What are the chances of getting a replacemnet? Should we get a lawyer to help us? Is there another form we have to file besides I-102 that can help our case? Thank you for you help! Have a blessed day!

File a FOIA request for his immigration records. As you know it is ABSOLUTELY vital you get a proof of legal entry, the I-94. It will take a few months. You do not need a lawyer however if that will make you comfortable, go for it!

Does he still have the passport and visa that he used for his last entry to the US? Does the passport have the arrival stamp? If yes, a copy of the pages with the visa and arrival stamp will be good enough without the I-94.
 
Yes, he was inspected of that I am sure. What do you think we should do? I fear that if we send the application for the I-94 replacement will be denied since we don't have much information. Is there anything I can do or go to in his presence? I was thinking to go to the U.S consulate in Mexico border to get a copy, but it seems very dangerous to go there right now. Do you think a immigration lawyer can help us? I really appreciate all your help! I am happy for you since you have many citizenships!:)

File an I-102.

He only knows he came through Brownsville Texas, he dosen't know the passport number, all I think we can get its the date.

Has he checked with his family back in his home country (or his parents here, if they brought him to the US and they're still here)? They might have a copy of his passport or at least know the number, especially if he was under 18 when it was issued.
 
He has a copy of a form they used to give them before they issued a passport. It has a picture of him and his mother when he was ten years old stapled to the form too, but it was revoked since it was from year 1986. He later came to the U.S when he was 20 years old. Do you think that would be useful for us?

It's not useful directly, but it along with his birth certificate and might help him with obtaining his last passport number from the consulate of his country in the US.

File for FOIA, I am in the same boat (passport stolen along with I-94). I filed for my request in April (for both FOIA and Visa records), just called y'day to check on the status of my request and they are still processing the April requests (it takes approx 6-8 months to get the info now). Filing I-102 will not help as you need additional information which you don't have. (some attorneys would probably tell you to file for I-102 and you will just be wasting your money).
Just remember proof of entry is very vital for AOS approval... so make sure you work on that first.
Don't believe everything an attorney tells you, make sure you do your own research too! esp in this forum it's very helpful.
