Lost H4 for AOS

Hi,

I lost my wife's H4 which was issued when I first started working in 2001. I asked my then attorney in vain to retrieve her H4. Is there any other way I can get a copy of H4 so that I can apply for I-485?

What H4 are you referring? Your wife only needs a proof of her current valid immigration status - and that is her current I-94.

In 2001, I worked for a company A, but after that I joined company B in 2002. Currently, I am aplying for AOS thru company B. My attorney says that I need to give him all the previous H4 documents of my wife before I file for AOS for her in order to prove the legal maintenance of status in US. I have my wife's current H4 (from company B) but I lost her previous H4. Her I-94 expiry date (the one attached in passport) is Sep 2002. I am not use if I am giving you the required information.

Did U loose both the copies of H4 ... I mean one is sent to Ur attorney and a coutesy copy is sent to you...

If you cannot get it .. then U can apply to UCIS to get the new copy of approval..

I lost my copy of H4. Attorney is not sure if she can retrieve her copy of H4 since it is too old a file (2001). I talked to UCIS who mentioned that the wait time to get a copy is 6 months.

You and your attorney are wasting time. As I said before you only need current immigration status to apply for I-485.

---------------- as pralay has said you only need your wife valid I-94(front and back) and your wife passport also has the stamp when she enter first time on H4

---------------- did you never filed her H4 extension???? till what date is validity of your wife latest I-94?????
when you joined B did you file her H4 extension with your H1 trasfer? did you file her H4 extension BEFORE Sep 2002????? if yes then she will be having her new I-94 attached with H4 extension approval.
*** you posted that your wife has current H4 filed through B? if she has H4 extension approval then she will be having new I-94 attached with her H4 approval notice lower Right side. if she has valid I-94 you can file her I-485.

------------- I think your wife came to US in 2001 with H4 VISA stamped by US consulate if that is true then how one can have H4 approval notice in 2001 for H4 visa holder?????
