Los Angeles interview: passport question

Hi guys,

I will have the interview at the end of OCT. I'm applying for citizenship based on marrying U.S. Citizen for three years. However, i just found out that my husband's passport expired this september. It takes three weeks to renew it in expedite way. I'm afaid we might not receive it before the interview if we do so. Thus, i'm thinking of just bringing this passport to the interview. Do you guys think it will be a problem? I don't know if the interview officer will check the experiation day carefully. Any reply is appreciated.
 
Expired passport is perfectly acceptable and won't be a problem. However, if he intends to hold dual citizenship, provided his country permits such an option, renewing now will be a good idea. An expired passport is perfectly fine, provided all pages are still inside...lol!!!!

I guess i didn't explain clearly. My husband is U.S.Citizen. I'm applying citizenship based on marrying him for three years. Now his passport expired September sometime. Is it still okay?
 
he has a birth certificate. but i'm not sure if his parents can find it. I don't want to deal with his parents at all. That's why i want to work with his passport. Please advise. thank you very much.

Updates: Shoot! I just checked County's website. It takes 20 working days to get it excluding mailling time. We don't have that much time. SIGH.... don't know what to do now. :(

Apply for the birth certificate anyway. 20 working days probably is an average, not a minimum, so it could still arrive before the interview. And even if it doesn't arrive before the interview, it's still useful for him to have it for other purposes. And if the interviewer doesn't accept the expired passport, he/she might still allow a few extra weeks after the interview to submit the birth certificate.

I don't see a crisis here, his expired passport is proof is his citizenship in this country. Since when is an expired US passport an indictment of one's citizenship? He can apply for a renewal, but will have to pay for expedited passport which he will get in 2 weeks guaranteed. What is your state? Do you know if they have a passport agency?

An expired US passport is no longer accepted as proof of US citizenship for various purposes such as entering the US from abroad*, I-9 and employment, or obtaining a driver's license. And the I-130 and N-600 instructions now say "unexpired US passport" as one of the options for proof of citizenship. Although the N-400 doesn't get specific about the spouse's US passport, so maybe the interviewer won't have a problem with it being expired ... but you never know, so it's better to get the birth certificate or a new passport if it can be obtained in time.


*for entering the US, a grace period of 6 months beyond expiration is allowed

You have 2 choices:

1)Go to interview with expired passport and see if they will accept it. Worse case scenario is that they don't accept it but allow you to get a new passport (or birth certificate) within 30 days.

2)Request to reschedule interview for a later date so that you have sufficient time to obtain a new passport.
 
Since you are in LA , your husband can seek an appointment with passport agency federal building, 11000 wilshire blvd,suite100, La 90024-3615 and expedited passport comes in a week. You pay addl $60/- and extra for Fedex to get overnight. please google how to get us passport in a hurry. schedule appointment with 1-877-487-2778. quite simple, they need personal detail, keep old passport handy and last 4 of ssn.
