Hi All,
This is Ram.I have a query regarding the H1B visa.

Right now I am in US on a B1 visa.I was in US from Feb 2011 and my B1 is stamped for 6 months (untill July 2011) and my employer is planning to apply my H1 this year in July or August.

I heard that staying in US on B1 visa for more time ( 6 months continously) will effect my chances of getting my H1B visa.I want to know how far it's true.I have an option to leave US after 3 months(by April 2011).So, In case if there are chances that my rejection of H1 increases because of my stay here in US on B1 for 6 months, I will plan to leave US this April. In case staying on B1 for 6 months and rejection of H1 are not related, I am planning to stay in US for 6 months untill July.

Please help me to take the correct decision for my H1 visa to be granted.

Thanks,
Ram

-----Visa is for entry to US and the validity of I-94 date states the date duration of stay and you should go out of US Before your I-94 Expires.
I have an option to leave US after 3 months(by April 2011).
---- Go out of US before I-94 gets expired.
So, In case if there are chances that my rejection of H1 increases because of my stay here in US on B1 for 6 months, I will plan to leave US this April.
---Go out before I-94 gets expired
In case staying on B1 for 6 months and rejection of H1 are not related, I am planning to stay in US for 6 months untill July.
---- How can you stay till July if I-94 expires in April? your stay will be illegal in US after your I-94 gets expired.
Please help me to take the correct decision for my H1 visa to be granted.
------ Give your education/ exp papers/copy of passport pages to employer or ask Company lawyer what he/she needs from you and then depart US before your I-94 gets expired. let the employer file H1 for you. Dont pay for H1. you wait out of US for H1 approval then employer will send you approval notice if H1 gets approved then go to US consulate for H1 Visa stamp and come to US on H1 IF the employer has real job for you and will pay you.
Thanks,
Ram

Hi Ginnu,

My I-94 does not expires in April. It expires on July 31st.

I landed in US on Jan 31st and my I 79 will be expired on July 31st

I heard that if some one stays in US for 6 months continuously on B1 visa ( Though his I94 is stamped for 6 months), then there are chances that it may decrease the chances of getting the H1b approved that may be filed the same year.

In case staying on B1 for 6 months is not good for the H1B approval, I will leave US in 3 months(April) and will apply for H1B (OR) In case theres no relation between the B1 stay and the H1 approval, I will stay until my I 94 expires and then leave to India and apply for a H1.

Do you feel the stay on B1 visa and the H1 approval are anyways related? (either positive or negative)

Thanks,
Ram
