My family were supporting for my expenses but suddeny back in 2006 i had a problem, my dad was diagnos with cancer and had to support my family for treatment since that day i quit my studies and started supporting my family for treatment and today he is doing fine and survived ...inorder to help my families i had to work full time and now i am out of status. I have been working in tax and even file for tax each year. April 2010 i got married with a gal who has a green card, she has been in this country for 1 and half year now and now it is 2011 and i am going to be a father pretty soon now what should i do... Am i still be able to apply for green card through my wife looking at my situation, what shouldbi do i need some good information regarding this matters....hope you all guys can help me out with a good suggestion or what should i do.....please help me out with this matter....

You have to wait until she gets her US Citizenship.
You can only adjust status and have your overstay forgiven if you are a spouse of a USC as long as you have a legal entry into US, which you do have.
Until then I'm afraid you have to stay under radar and try to not get caught by USCIS.
That is the only option you have at this point to stay in US.

Yes i have a legal port of entry in united states and have not done any offense since my stay and have my legally married court certificate and proof....if i can adjust my status how that can be done

Congratulations on the upcoming fatherhood, I hope the birth experience will introduce you to the life of parenting and comforter-in-chief. Living your life under a rock is what you need to become competent in for the next couple of years, if you are caught by Sheriff Joe Arpaio, then deportation is your ultimate destination and 10 years banned from entering the US. If the question is, can you get a green card NOW to support your wife and newborn, at this present time, absolutely NOT!!! Your wife will need to become a US citizen and sponsor you, which your unlawful presence will be forgiven by USCIS.

The key issue which I am interested in is this: How were you able to be employed without proper documentation? Did you buy some social security card or green card from someone? Did you claim to be a US citizen in the I-9 form? If you can answer these questions, then it will give us an idea on your chances for a green card in the future. For example, if you claimed to be a US citizen in the I-9 form, then you will NEVER obtain a green card, because such a claimer is like a sword ripping through your flesh...death kiss.

i have everything and even i am driving ...i don mind if i get deported....well sir i am paying tax with my own social security like a us citizen or green card holder and some people even don have valid id to proof......well to say i don have any status but what i do everything is good and i have a valid ss no where i pay tax and file my tax return every year whic is the good thing that i am doing that even though iam not authorized to work...i did break the law but am paying back as a god citizen even though i don have status otherwise who does that......what i have is legal nothing is illegal and i never lied on any form or pages to prove that i am a us citizen...nothing is illegal except my status and i don apply for benefit nothing jus paying tax....thanks

Take it easy! He's just trying to ascertain whether or not you're eligible for a green card. You just opted out of school, understood!

Relax power66, people on this forum tell it like it is. It is all for your own benefit dude.
It would be great if your wife can support so you don't have to work. However, given your circumstances, you probably did what you had to do. I'm not saying its right. But when a man gets desperate, all options become fair game.
I hope your wife is able to obtain USC status soon, so that you can start the process of becoming legal.
Good luck...

With the above information, then all you have to do is once your wife becomes a US citizen, she files for your green card and you won't have any issues. I don't think you understand the implications of deportation, but that's something which you will probably need to read on and learn about it. If you never claimed US citizenship, then your green card filing might be successful, provided you have no other issues. What state do you live in? Don't visit Arizona, even if there is $100 dollar bill rain in the forecast...:)
