Just a little explanation of the situation..

I live in the UK, and my girlfriend lives in the US as a US citizen..

We have been looking at the various routes that we can be together..

Can someone please explain our options..To be honest, we want the quickest route. I have read that people in our situation, where the non US person visited the US on a non-imagrant visa, got marriade after 30 or so days into the stay, and applied for the change of status? Is that correct? pitfalls of this?

Hope someone can help me along with this please

Thanks in advance

Niko

If you both are engaged, then go with K-1
If you both are married, then go with K-3

Entering US with an intent to marry can be a cause for denial esp if you knew each other in the past...

Yes, that is my thoughts on it aswell...

is there anybody who can explain the K-1 visa process to me...Who has to start it all off etc etc..

Intent to marry is not the issue, it is the intent to immigrate when one enters the US that can cause an application to adjust status to be denied. There is nothing wrong or illegal about getting married in the US.

atnixon,

The pitfalls of entering the US, getting married and then applying to adjust status, can mean that your application can be denied if it is found that you had immigration intent when you entered the US (which you would have given your posts here). You then very well could face a ban. Have plenty taken this path under these circumstances, yes. Have there been approvals and all is ok, yes. Have there been denials, yes. A totally different scenario then if one enters the US and then decides to get married, and applies to adjust status, as this is an option to those that are granted entry and are otherwise eligible.

Here, you can find other experiences for the K-1 visa from UKers, as well as a Guide to filing the I-129F. Aso have a look at this K-1 Flowchart. They should give you a good start to understanding the K-1 process.

All the best to you.
