Looking for information on namechecks...

Hi.

I've always known that you have to do FP as part of the I-485 process but recently people have been mentioning namechecks, something which I'd never heard of before...

If anyone knows the answers to the following, that would be much appreciated:

#1 These aren't done for everyone, right?

#2 Any idea what determines whether the USCIS asks for a namecheck?

#3 Is it possible that your country of origin would influence whether they ask for these?

#4 Any idea what % of applicants end up having namechecks done?

#5 How long can these take?

#6 What is involved?

#7 How can you tell that the USCIS has asked for a namecheck?

If we get some good answers to these questions, maybe we could stick them in the FAQ thread...

My understanding

is that everyone has to get a name check. The name checks rather are against various databases of the FBI, CIA etc. Most checks get done in a matter of hours/days, while a small minority gets stuck for further scrutiny. There is a document that describes USCIS's operating procedure on this web site - that describes the whole process in detail. Also you may want to read through Rajiv's deposition of some USCIS officers, also on this website, which further answers some of these questions.

It sounds like these are done for everyone, that they usually take as little as 1 week (if there's no hit for your name in the database) but could take as long as 18 months (if there is a hit).

Unfortunately, it looks like there's no way to know if your case is waiting for a namecheck to clear (due to a hit against the database) unless you call the USCIS / FBI...?

Is it necessary that I-140 should be cleared before we do fax to FBI to check NAME CHECK ?
