I am looking for guidence and information on applying for a green card or perminent residency for my fiance. The situation is this:
I'm an American, I moved to Mexico when I was 15 by my parents orders(I am now 21, my fiance is 22). I have been here for 6 years now. 3 years ago I met someone and we have had plans to get married since 2011(Our first anniversary was him asking me to marry him). However we have struggled nonstop to get married in Mexico(because I am foreign the expense for marriage is extremely high) and my visa here will expire this March and since I am not unemployed and unable to find a new employer, my parents have since abandoned me and I do not have an outside of Mexico income - I won't be able to apply again until I get one of those things. My fiance has a 10 year visa, he visited the US for a work conference last year. Previous to his 10 year visa he had another 10 year and he has never over stayed any limits or comitted any sort of visa fraud. Our hope is that we can fly to the US and get married on our upcoming 3rd anniversary(March 25th) and apply for his residency then. I understand that I'm supposed to petition to bring him but as we have been in a relationship for 3 years living together(we've barely been apart for more then a week in 3years) I don't think I could just spend anywhere from 6 months to years without him. I am not so much worried about having an application denied because it's not believed that we love each other, because I don't think that anyone could think that we don't.
What I am wondering is what papers will we need to file when we are there and how much approximately should it cost?
Also, what if the process takes a long time and his current stay expires? Can he extend his time on grounds that he is in the process and has a 10 year visa? Or will he have to go back temporarily?
